RE: Frustrated in Illinois
(01-01-2011 09:57 PM)lm10529 Wrote: New to the forum and wondering if anyone has any thoughts on how to cope and get through this mess called WC. In Feb 2010 I injured my shoulder and neck while working and had surgery on the shoulder in April.I fully expected to have returned to work by late summer but still not back to work and no date in site as to when I will return. Due to the nature of my job, my employer does not have light duty. Since surgery I have not been able to regain strength in the shoulder and finally after exhausting all avenues my Dr is wanting to do another surgery and currently waiting for WC approval for 2nd surgery. As of Dec 6, I received a letter from my employer stating that they had terminated all my benefits as of Dec. 1 and to be expecting info regarding COBRA and as of last week I still had not received any info, when I contacted my employer as to why I had not rec'd the info, they stated they had changed my ins. drop date to Dec 31 and forgot to tell me.....nice. Does anyone have any ideas how to deal with the health ins/Cobra issue? My attorney says to just find a way to pay. Thats easy for him to say when he's not the one that is on WC and having to pay for COBRA. I am just so frustrated with all of this right now. Everything just seems to be dragging out a whole lot longer than it should be. Is this the norm with WC? Vondrake Here. Be thankful the insurance carrier is fairly consistant with your check. I spent 3 years seven months without a dime before I made it to the appellate ct. As a fact my case now stands as case law. Here it is NINE years later and if I didn't bounce my attorney higher than the space shuttle, I would still be appealing. Check into the State as they will give the children some type of medical. Cobra is over the top, for myself they wanted almost $1400.00 a month seven years ago. Forget about help from a Union.......I have contacted the Chgo District Council of Carpenters a long time ago. They are aware of what these crooks are doing and have done nothing to my knowledge to help. If it wasn't so tragic it world be funny. I recently spoke with my former attorney for over an hour while I went through the list of everything he did wrong, including steal from me and he kept saying why don't you just go on and live your life. HE JUST DOESN'TGET IT AND HE NEVER WILL! Why! in a no fault system a man or a woman with a legitimate calm for injury Why! should everything you worked for including your retirement be thrown in the dumpster just because you had a work related injury. That is NOT how the statute reads. It is because of how it is practiced by the insurance carriers and the lawyers who practice before the politically connected Illinois Workers Compensation Commission. GREED! is a huge factor and somebody has to feed the lawyers and unfortunately they have no incentive to move your case along. The longer the litigation the more money they make. Every darn lawyer at the IWCC knows about the 19b-1 and to NOT file it per instructions from the IWCC. WHY! simply because the state cannot comply with the 180 mandate so instead of hiring more arbitrators etc to COMPLY with their own state law they decided to take it out upon the injured of the State of Illinois by only hearing a few or no more than a dozen. This has been going on for TWENTYSEVEN YEARS and every lawyer down there KNOWS IT. Any attorney out on this forum who would like to join me in a class action in federal court I would WELCOME you. I have been turned down by no less than TWENTY lawyers who are scared to death to go against their peers and the State of Illinois. I have asked for a Federal Grand Jury and I will eventually get one as the US Attorney's office wants me to go back to the FBI. There is a lot to my story only in my case I caught every dirty little and sometimes illegal trick they pulled. ( including the AIG doctor making TWO reports one 1,000% against and the other 1,000% for you. Problem being he only saw me ONCE with all facts remaining the same) The ARDC has two open files and he will have more. The State is delayed, tried to cover up, and has fought me every step of the way because they know I'm not going away. NOBODY! is going to take away my CIVIL RIGHTS PERIOD! and when the aribtrator (GALICIA) asked me what I WANTED after I turned down almost a quarter of a million I told him exactly. To use the POWER and the right of the IWCC to FINE AIG insurance carriers 30 million dollars and use the money to not only hear 19b-1 emergencys motions again, but to comply with the 180 days and with the law of the State of Illinois. I also asked for a check for life which he awarded, and the Commission took away. Out of the three Commissioners who gave me that discision Sherman RESIGNED, Rink, retired.........Governor Quinn, Lisa Madigan, Senator Susan Garrett, and a newspaper ALL KNOW whats going one because I told them all. Only a Federal Grand Jury will eliminate what the insurance carriers have set up with the lawyers and state coming along for a profitable ride. Warm Regards VONDRAKE. |

RE: Frustrated in Illinois
You fall within that 20% of injured workers who have trouble with work comp.
You need to become an expert on resources available to help your family. This is difficult to do when in constant pain as I speak from experience with this. Do you have a spouse who can help you with the leg work required in locating resources? The best place to start, google 211 United Way, a web page will come up and you need to put in your zip code on this page. The next page will list the type of resource, on this pages you need to be a litttle specific about the types of resources you are looking for, medical help, assistance with rent, food? I suggest calling 211 United Way. The workers who answers the phone are specialist at locating resources which sometimes requre thinking outside of the box to find the help a caller needs. The resources listed are more comprehensive than just the Unted Way funded programs. |

Vondrake Here, Thanks for the info.........but I am almost through with that nut house. I have read much and soon be taking my dear old former lawyer to the courthouse........in a seperate action out of the jurisdiction of the IWCC. I will however use some of these clowns (state IWCC employee's) as a material witness and I will cut them to pieces when I get them under oath. In the meantime I have a story I'm waiting on..... to run here in Illinois in the Daily Herald so I can go back to Mr. Patrick Fitzgearld's little band of merry men called the FBI. A Senator downstate has called for an independent Federal investigation, of the state workers and I told the reporter that when I get one started from the north with them coming from the south we'll just meet in Springfield. :+)) I do believe they fear me to a degree because I can write a damn good petition and I know how to serve a subpoena. Law is now a big hobby of mine.........and if I was a young man I would get a JD but now I'm officially retired and I'm going to make sure at least one man who has a JD never will do to anyone else what he done to me............its not revenge..........Its JUSTICE! Warm Regards VONDRAKE> |
