texas wc with a back ijury not treating help!!

my dad was injured on the job. surgeon says the only thing they can do is fuse his back on 2 levels. workers comp continually denies surgery he cant work. he is constantly in pain continually getting worse close enough to where he leg is almost a rag doll took a test and he has lost 90% of strength in his leg. comp still denying surgery continually and now comp wants to stop all his medical and give a few weeks of pay and let him get surgery any way that he can. do you have any sugestions
they say he dose not meet qualify cations for hernia surgery and back surgery for two years. They are supposed to pay Intel January 2012, he just got a letter today 12/07/10 for a [mmi} maximum medical improvement. He has not been to surgery he has been denied a number of times for stupid reasons. My mother is disabled; I am a senior in high school at Klein Collins high school. And we have been struggling sense December of last year, my dad can’t afford the diabetic medicine he needs he has been out of all of it off and on for about 2 months. Even though workers comp is supposed to take care of the people who get put in this program. he just about had a hart attack when he read the letter to day. So pl If there is any thing you know that would help pl let me know.

texas has strict rules for medical treatment in the hope of eliminating unnecessary and risky surgery.
your dad can appeal the denial.
he may wish to talk to the ombudsman about the process for filing an appeal.

In Texas, If a treating dr has recommended surgical intervention and the IC denies the advice of the treating dr.. The treating dr then resubmits his/her findings. If the IC denies it again. Then you can request that an IRO review it. What ever the IRO says, is the way it is. Meaning, if they say surgery is needed, then the IC has to cover it.

robert 58 injured jan 23,2009 did acc. report company did not send me to dr went to my dr continued to get worse and worked full time did gi series showed hernias report to work argued about not inj at wk. sent to co. dr july 09. went to co dr 50 plus times july to dec 09. no diagnosis no meds vomiting 20 xs day extreme pain request diff dr co. dr said no rx I dont know how to treat diabetic. refused reder me 4 times. begged HR 6 times in 6 wks to go dif dr told me shut up quit complaining have no choice have to go to our dr. about sept placed on restricted duty 25 lb max lift.Went on vacation dec14/15 09. extreme pain HR called me at hm dec 17/18 told laid off asked to be put on short trm disability for the 10th time denied .filled out form to change dr went to surgon immediate diagnosis need fuse back 2-3 levels put on comp jan 17 2010. Surgery requested . denial
1.need physical therapy already did 35 sessions co. clinic july aug sept
2.need steroids c2-c3 injections diabetic and complications 18 yrs ago ordered never do by drs. also BBBBad for glucose control can kill me asked about lumbar cervical no make sense 3. ansaid therapy BBBad for diabetic ordered no do by drs 4. psychiatry eval saw shrink said a ok for surgery. 5. denied because denied before stupid dont make sense. 6. iro review co. clinic no records sent only mri from new surg denied 7.july had trial judge denied records to be admited that would help me denied again and appealed had to redo judge damaged audio for appeal in october judge denied surgry in appeal sent to ddr for mmi nov 9 2010 refused mmi dec sent video of me and my son in yard derogatory to me seperate video claim my son is me violate restrictions did not violate any sys i did funny my son not me ddr now put me at mmi back dated to nov 9 5% impairment no more income after 2nd wk feb should pay tell jan 2012 now lost every thing WE own house my be forclosed on any day. wife disabled 15 years. need back surgy abd hernia surgy no money etc. pl tell me if there is any thing left you can think of me to do........

i also showed the video to wallace at fox26 news saw me limping doesnt understand why i cant work DRS orders said i did something to piss them off yea got hurt been off work a year he has no understanding of a back injury tremendose pain fall down frfequently etc DRS tell me move stretch do back exercises walk as much as possible etc told him injured not bed ridden he has no understanding told me I must be a bad apple caused problems implied I am crazy be cause I was ordered to see Psych consult
Blew me off as being able to work WISH I could work been begn food from churches etc 17 yr old senior me and disabled wife. I told him call my boss I am and was a very good employee he didnt bother told him to talk to DR about back injury and check out ODG Guidelines told him if you do not want to help me help others in texas that even social security told me no one gets anything approved anymore. everyone let me know if you have been denied denied etc. and shoved out of the system as well. NO ONE knows our plight all of us that are being screwed by workers comp and denied medical care need to everyone email your own problems to wallace@26investigates.com think address is right if not check 26 news PLEASE REPLY I wonder how many of us are bad employees causing problems CRAZY etc. let me know
