i have to call my lawyer today. do i say to him no thank you or do i give him an amount i counter with? i know 99k sounds like alot but i dont think it is. and ins comp knows most people jump on it

Blake tell your lawyer what you want and then ask him is this out of line? most likely him and the other lawyer have already had lunch and he knows the top dollar they are willing to go

im calling them today im just trying to come up with an amount that the ins comp will go for. my lawyer asked for 105k that number they came up with i didnt and the ins comp came back with 99k. does anyone have an idea what i should ask for? im sure if i go to high the ins comp will prob say scew it you get nothing. my lawyer said once the ins comp has to make the 211k payment into the aggregate trust fund then it will be harder to get a settlement because then its in the states hands. i dont get it. i mean if they are gonna have to pay that amount into the fund shouldnt they settle for more than 99k if is ask for more? this is a very tuff decision

If they settle now what makes you thing they will be paying anything into any fund? Sorry I just don't understand that part. One thing to ask yourself is can I live on that for a settlement? How does that work for you over the course of the rest of your life? One thing for sure if they are the ones wanting to settle now there is a good reason for it. And it means they are wanting to save money. It's very hard for anybody outside your case to say what is a good amount because there are just too many things to consider and without knowing all it's just to hard to say. Your lawyer is in the best place to say this but sometimes all they are thinking about is how much is he willing to take to walk away now. Good luck

thats what i mean as soon as the judge ordered them to pay 211k into the fund now all the sudden they want to settle for 99k, do i try to up that offer from them before they are forced to put the money in or do i say no ty and let them just put that money in the fund and continue to go to school and collect my weekly benefits? i dont think 99k is fair nor enough to live the rest of my life on im only 32. i know you will never get rich i just want what i deserve. i know my back is only gonna get worse with time. i guess the settlement is 7 1/2 years of payments and my lawyer says thats alot.

so i am gonna tell my lawyer today i will take 100k flat with the ins comp to cover the 12.5% for my lawyer. i guess if they are the ones who want to settle so bad its worth a shot right? i figure thats a fair offer without asking for a crazy amount. and if they say no oh well i guess

blake - I assume you trust your lawyer, and I would go with what he says. I live in PA, and I asked my lawyer what the AVERAGE settlements was, I asked him what would be a fair or average amount to settle for, he told me that average is about 2-7 years of payments. With 2 being very very low and 7 being very very high. It all depends on your individual case. If you are permanently disabled, social security can help fill in for some income after you settle. it's not alot, but its better than nothing.
My attorney asked for 8 years of payments and my insurance company said outright NO. TOO MUCH. They seem to think that there is some kind of job I can do, even though I can barely get out of bed in the morning and dont even function well enough to get into a shower till about 3 hours after I take my morning pills.

well i said no to the 99k offer and my lawyer called them back and they came back with 104. now thats 8 years of payments so its very high on that end and they ins comp said thats their final offer is it? the hard part is come febuary they have to put 211k into an aggregate trust fund so why should i get more than 104k? this is a very tuff choice part of me wants this over and done but i want to make sure this is best for me and my family, i know sooner or later i will be told i have to testify again about the labor market thing because iam able to work with restrictions, i know i wont be getting my weekely payments forever even though i have a perm partial disability. my lawyer called today with this offer.

If your settle now why are they putting funds in a trust in Feb? Sorry I just don't understand because it would seem like if your are going to settle now everything would be done at settlement
