Hi, I have posted before but I am now a little more familiar with WC. I live in NYS. I hurt my ankle and have been given a 50% disability rating by IME. They have just scheduled a hearing for next week. What happens at a hearing and what might I expect as a settlement?

if you are buying out your future medical coverage( section 32) there is no way anyone who is not familiar with the details of your case can put a price on it.
if the worker with a Permanent Partial Disability does not perform a “good faith, diligent” search for work, or obtain work even if this means accepting a lower-paying job, the worker may no longer be entitled to draw weekly Workers’ Compensation benefit checks under New York law. settlements involve complex calculations based on these and a number of different factors and can't be computed on a message board. for more information http://www.wcb.state.ny.us/content/main/...tion32.jsp for general information on hearings: http://www.wcb.state.ny.us/content/main/...gs_OTJ.jsp |

then you dont get it.....you get the max....
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....
