WC playing games with me, what can i do?

hi my name is kylee, i am new to this and just found this forum after searching workman's compensation stuff. hopefully someone can help me out here. this is what i know and what has happened to me. feel free to comment, i need advice.
![]() i work a ***** edited by admin ***** in new york. nov 2nd i injured my neck and back while moving old mattresses out of the hotel and bringing new ones in. shortly after my injury i told the general manager where she filled out the correct paperwork and off i went to the hospital. here i was diagnosed with a severe muscle spasm to the right of my C3 vertebrae of my cervical spine. the third one down from the base of the skull. also severe back and tail bone pain. everything was very stiff and painful. the ER doctor told me to follow up with my primary(which i dont have) and schedule an MRI. after finding out i didnt have any insurance or a primary he told me a few places to try to call, also told me to not mention it was WC because they might just not take me due to that. i began going to a occupational wellness place, where the "Dr" i saw was an RN. she did nothing to me, no MRI, no xrays, no prescriptions for meds, didnt even LOOk at my back or neck.i saw her 3 times and through her began 2 days a week of physical therapy. i was told to take 4000 milligrams of tylenol per day which seems outrageous considering more ppl die from acetiminophin in a year than ppl die from ciggarette smoking...besides the point. as of nov 22nd i was told to report back to work on regular duty, though im in more pain now and since then, than i was in since my injury. i was seeing a referred phyisical therapist 2 times a week for about 2 or 3 all together. i usually hurt alot more after therapy and didnt feel that i was getting the correct treatment. so i cancelled there and found a new and much closer to hope physical therapy place. this place asked questions the other place never asked. they also concluded that they believed the treatments i was getting from the previous PT were not helping my problem. and they started all over. ive had no doctor visits since, only physical therapy. from what they gained from the appointments is that they are sure i have disc damage and internal bruising up and down my spine. they then refered me to Buffalo Spine and Sports, to schedule an appointment with a spine doctor who could also give me an MRI. this is dated Dec, 17, this year, so ive got a week or so before i get there. i started to believe things where beginning to look up for me. in the meantime i received a letter from my WC case carrier, stating that i was not legibale for benifits because my medical records didnt exceed 7 days. (though i was off for 20 days). i went about calling the number i was given to contact my case carrier, ***** edited by admin *****. i called her several times with no answer and left numerous messages, stating my case number, and wondering why i couldnt receive benefits because what was marked was wrong, i left my phone number and name and asked her to call back. 2 weeks went by before she called me back since my original call to her. today she called me back, after 3 very descrete short not understandable talks with her, she lastly called stating that supposidly my ER doctor stated that i said something i didnt say. she says the DR stated that i told him i was injured in the same place 2 days previous to my actual injury! that is a lie! i told her that was outrageous and not true and she simply told me i could try to get on DBL? or something to take care of 50% of my normal weekly pay. she also stated that is for ppl who are NOT injured at work. I WAS INJURED AT WORK! i dont know if she is lying,i dont know if the ER dr is lying. but this is ***** edited by admin *****. ive had no source of income, ive had to take my car off the road and i am not capable of paying my rent, feeding myself or my dogs. its also the holiday season and it really sucks for someone with NO money! i am not a wealthy person and ive had to borrow alot of $ from relatives just to get to my appointments and such. this is rediculous. its mid winter and i didnt have work for 20 days and didnt have pay for a week longer than that! and just got my first check a week after i had to go back to work. and unfortunatly they have me on 1 or 2 days a week now... my pain is worse than before and i cant wait to get it taken care of,but if im not covered by workmans comp, than how can i continue my dr appointments and physical therapy, or even the much needed MRI i supposed to get dec 17th!? i dont kno what i can do about this, i called an attorney and scheduled an appointment dec 27th. but the lady told me she needs to get a copy of my ER records...but if its this ER DR thats pulling ***** edited by admin ***** then im sure these records arent going to show much, considering he can write anything he wants right? please,someone help me. kylee |

You needed to sit down with a lawyer like yesterday. One doesn't necessarily have to wait til the 27th. Man! Find another lawyer. It's best (in your case) to plop yourself down on a lawyer's couch unannounced. The sooner the better.

Hi Kylee, Welcome to the forum. just wanted to let you know that insurance company adjusters troll this forum and it's not particularly safe to give any hint of place of employment or names on here. The only info you need to offer is your state , injury and your questions. better safe than sorry . Hope you went to see a lawyer cause it sounds like you're gonna need one. Please don't take anything the insurance company does personally , they do this to most injured workers , but , do go on the offensive because they will do whatever they can to make your life crazy until you say screw it. Stay strong and kick them back. Take care

Okay my friend, take a deep breath. Welcome unfortunately to the painful world of work comp. Paper trail, establish one now, copies of what you filled in at work. Go to the medical records of the hospital ER you went to and get copies of that visit.
Realize that the case worker's job is not in your favor, she can say anything she wants. You need a lawyer on your side to protect your rights, get you medical treatment and to pay your bills. We're not experts here but we have a wealth of knowledge because, well frankly we're all in the same boat. Injured workers who care about each other because the system doesn't care about us. I've been an injured worker for over 5 years, unable to work because of what was originally a simple injury. Unfortunately my first work comp doc ruined my left knee and I've suffered ever since. So I come here for advice, comfort and frankly it's nice to have people on your side who understand 100% what you're going thru because unfortunately we've all been thru it, still going thru it and WE supoort each other. We cry, laugh and yes, pray for each other. Realize my friend that once you hire a lawyer, that crappy lady you spoke to probably won't talk to you again (you won't miss her). If she does she'll be even nastier. But if you hire a lawyer let him/her talk for you. As I stated earlier, paper trail, document everything, ask for copies of everything. Welcome Kylee and I have a daughter with that same spelling. Kind of sorry to say welcome to the forum but glad you found it. The world of WC is not a place I wish anybody to be in but you have found a place that can give you some help in your fight. And remember that word because it can be a fight, and sometimes for our life. Almost nobody is your friend in WC. Employers can act like they are your best friend once you are hurt and sometimes they are but if your injury is going to cost a good deal of money then watch out. In this world you would think a doctor would be your best friend, and sometimes they are but again watch out. Trust nobody until they give you very good reason to, and I mean VERY good reason. Now with that being said it maybe hard for you to want to trust anybody here but there are enough folks on here that will help guide you in the right direction. Ask questions and hear what we say. I don't think anybody on here will ever tell you something wrong but do your research with the help of answer you get here and make your own ruling.
A good lawyer can do allot to help you get the treatment and care you need to get better so make sure you talk with several and find one you can trust because they can make or break you. Sorry I need to go but would like to say more but for now I will say a prayer for you and hope you can get the help you need to get better |
