My question is can I negotiate with the IC that I want open medical but do not want a settlement nor do I want a disability rating...Based on how I feel, I think I am going to need continuous phys therapy for a long time.I told my doctor I feel well enough to return to work full duty and he agreed but wants me to continue with therapy so my condition stays stable and does not decompensate. I agree with him because for over a week that I didn't go to therapy, I felt alot worse.
I want to clear up this workers comp situation, want to be a full duty employee, don't want to jeapordize anything with my employer such as getting a settlement and don't want to jeapordize future employment with a disability rating, but still want the ability to go to the doctor for therapy if needed. Can I do this? Can I tell the adjuster I dont want to proceed any further but want medical? |

technically yes,
the parties could submit stipulation papers agreeing to a 0 percent PD rating and future medical as needed. it will have to have supporting medical evidence in order for the court to accept it. california has a hard 24 visit cap on physical therapy/chiro treatment. it can be waived with carrier agreement so you will need them to put in the stipulation that they've agreed not to apply the cap. medical care will still have to meet the utilization review rules. |
