OK, after the doctor gives you the ok to return to work, how long from that point do they decide if you are MMI or does that automatically mean you are MMI when he returns you to work. Second question, if you return to work full duty and they have no work available for you then what, do you go back on TTD or unemployment???

If your employer has no work for you, and lays you off draw unemployment. If you reinjure yourself at work then refile workmans comp. Im not sure doctors work with you long enough to call you MMI their job is to get you back to work as fast as possible. So be careful. |

a doctor's opinion that you have reached Maximum Medical Improvement varies with every situation. there is no set time period.
return to work is not the same as an MMI determination. many patients medical condition changes after they have returned to work. it depends on your state laws but generally if your condition no longer temporarily disables you then you are not eligible for temporary disability payments. you can get unemployment if you meet their requirements. |

In NYS if you have a partial disability and you have to return to work with light duty work and your employer has no work for you you can sign up for umemployement because even though you are light duty you can still work...i went through that many years ago and i got comp and unemployement when i couldnt get a job but instead went to school full time for a different career and recently my cousin was getting no fault payment from a car accident and collected unemployment while going to college full time BUT im not 100% sure it still works that way now being on compensation but soon i will find out...
