WORKERS COMP PAYMENTS
YESTERDAY I RECIEVED A LETTER FROM WORKERS COMP SAYING NOTICE OF PAYMENT AND IS ALSO SAYS THAT THE LETTER SHOULD BE SENT TO THE INJURED EMPLOYEE WITH THE FIRST CHECK. LET ME SAY THAT I GOT INJURED IN APRIL OF 2009 AND I HAVE AND ATTORNEY HE SAYS THAT HE DID NOT RECIEVE A LETTER BUT I DID.(WHAT DOES THAT MEAN) I WON A JUDGEMENT OF BACK PAY AND MY ATTORNEY WAS ALSO AWARDED MONEY FOR SERVICES AND ALSO PENALTIES OF 6000 WHO DOES THE PENALITIES GO TO? ALSO IT HAS BEEN PAST THE 60 DAYS SINCE THE JUDGEMENT WAS SIGNED BY THE JUDGE. ARENT MY WEEKLY PAYMENTS SUPPOSE TO GO TO ME AND NOT MY ATTORNEY WHENEVER I RECIEVE THEM? IM CONFUSED ITS BEEN TO LONG.I LIVE IN THE STATE OF LOUISIANA IT HAS BEEN A YEAR AND 7 MONTHS I AM VERY DISGUSTED AND NOT TO MENTION IN PAIN. CAN SOMEONE SHED SOME LIGHT ON THIS?

To start with, please type in lower case, unless you truly are YELLING at someone. It's just proper forum etiquette. Secondly, my opinion is that if you just got the "Notice of Payment" yesterday, that something like a check will be forthcoming shortly. I find in my case all the letters I get are "generic" and can't be taken word for word. Hold on a few more days to see if a check comes and if it doesn't, call your attorney again. Sometimes checks are sent to attorney; sometimes to applicants, and sometimes even to employers. It depends on the situation and everyone's is different. All my checks went directly to my employer because I received "salary continuance" while on WC TTD. Who gets the penalties depends on why they were filed. On late TTD they generally go to the injured worker; but I believe in some cases the attorney may be entitled to a percentage if considered part of the settlement.
