Hi, I hope someone will give me some advice before I go back to the war zone. Here's my story for the last time.
Oregon; On job injury. Housekeeper, R shoulder. Surgery. light duty. Fired (no more light duty). UE says discharged. Boss says not. TTD payments. IME. Ok released back to work no restrictions. My Dr says no restrictions, no more treatment will help. Lawyer. I am considered new hire? or just injured returning back to work. Boss will get the benefit of having injured worker. I'll get further damaged. Will this be a new claim or pre-existing? Do I need to keep my lawyer? Hostile work environment in future. HELP! Thanx

My question, are you still under the original employer from whence you were injured?

You have a lawyer, did he not send you for an independent IME before you returned to work? Are you still having the same symptoms from before or have they never resolved?

Keep your lawyer if he/she helps you with your current needs. Without an explaination as to what your original injury was it's hard to comment.

Hi, Yes I am going back to the same employer at the same job where I was injured. The W/C sent me to their IME who is sending me back to job. I still have a lot of pain and mobility problems and with no restrictions I see more pain and issues with my shoulder. I was never evaluated by someone who tests your strength, motion etc. Thanks for you inquiry.
