An issue I'm having

I broke my big toe on my left leg on September 8th 2010 at work and I was out from work until the October 3rd 2010. My doctor cleared me to go back and only perform "light duty" a week before the 3rd but I was still uncomfortable with that so I settled with my manager to take off for 1 more week.

My issue is that I was never paid anything, only thing covered were the medical bills. This is my first time ever being injured on the job and I'm only 18 and I'm a part time employee. I assumed I was just going to be paid while I was gone but I never knew or was told I actually had to file anything (such as workers comp) I asked my the Head Manager why I was not paid while I was gone and he said it was because I did not return when the doctor cleared me for light duty. His answer does not make much sense to me to be honest. I thought I was not paid because I'm part-time and don't have any benefits such as off-duty pay

I'm still going to call Worker Comp to speak to someone but I figure I would post my issue to get a little bit more insight on what I should do.

I am afraid you have an issue here. Texas is a strange state. It is not manditory that employers carry wc coverage. If memory serves me. You have 30 days from date of injury to file a wc claim.

if your employer has workers comp insurance you need to file directly with the work comp carrier.
if not, you can file a law suit in civil court.
the employer has to notify you if he has comp insurance or not.
