Is this a new injury or an aggravation of my previous injury?
I fractured my distal fibula 6/17. No surgery needed, the fracture healed on it's own. The sprain however was very severe. I was just released off of light duty 10/18 to full duty (I'm a RN). Today while walking in the woods (I am hesitant to use the word hiking here because it was an easy walk) I stepped wrong and re fractured the same ankle. I have not been completely released by my doc from the previous injury. Will this injury be covered by my previous claim or will I have to eat the time off? I was wearing my splint, I was well within my restrictions, and I KNOW that if I hadn't sprained my ankle so badly in June, this break would not of happened. My doc knew that my ligaments were still really lose and STILL released me back to full duty. I am in TX btw if that makes a difference.

Please help! I need to know if I should get ready for a fight or if I need to roll over and take it.

aggravations are injuries.
it is basically a medical decision but it should be filed as new injury even if just a temporary one.
unless your walk in the woods was in the line of duty the new injury will likely be covered by your health insurance.
you didn't say whether either injury was work related or whether your employer provides workers compensation insurance.

Sorry. Yes the initial injury was considered work related since it occurred in the parking lot on the way in to work. Yes my employer does provide workers comp insurance.
