Workers Comp Question, PLEASE HELP!!!

I have been on wc since jan 11. thursday 11/21 i go to the dr and he is going to perform tests to see if i will be able to go back to work. i live in ky and dislocated /fractured my left elbow. my left arm is like a #7 now after 1 surgery and pt. it just wont straighten out or bend . it hurts like hell all the time. what will happen if my dr determines i cant go back to work for the company i was working at. it was a physical labor job? will comp try cutting me off or settle. im going to a laywer tomm. i should have earlier but i have had no issues with the wc until now. im just scared i am goin to be sol and have to suffer the rest of my life. PLEASE HELP!!

I don't know how WC works in KY but here in MN if you are hurt you have 104 weeks of TTD, and life time medical. NORMALLY. If you arm is hurt like you say I would not worry about it. But I would also research and get a lawyer asap. They are pro bono here in MN and I would think would be the same there. The lawyer will be your best friend in this time of need. They will sift through the facts and stand up for you and handle all of the legal headaches when push comes to shove. Just remember they are only looking out for there pocket and not always yours. This being said, you can trust them, but always look into why they want to do something and UNDERSTAND IT. That is very important. Are you going to an IME? If so, do not lie and be honest as always. The fakes are sifted out in this process and when your lawyer is chosen they will be able to help you will all the bs that comes with these IMEs.

benefits can't be started or stopped with supporting medical evidence; so it depends on what the doctor says.

what do you mean when you say this 1171??? also moment29 what is a IME?? if you are referring to the physician it was a dr of my choice. i have a consultation with a lawyer tomm i will report back and let you all know what he said. what scares me is I worked for "the city" and i am going to a neighboring city a lawyer. its a smaller town ky and i dont get want to get sold out by the lawyer |

you think they dont all play golf together? they do..... but his paycheck depends on your paycheck....if he feels you have no case(or will make him no money) he wont take your case.....
IME=Independant medical exam....... ;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

janye is spot on. All the lawyers and most of the judges are just a network. They all work "together". Facts are facts and that can either make or break your case. If your trying to defraud the a company, well then I would worry. But if your not, then don't worry. Good call on the lawyer. If you don't like them, research and find another. Just don't get the guy off of tv or the radio. Look for referrals and word of mouth. Best of luck!

IME stands for Independent Medical Examination. This doctor is chosen by the insurance carrier, they have the right to send you to a doctor of their choice.[/align]

rnet, 1171 is corect.
Your benifits began because of medical supporting documentation. Your benifits will not end without medical supporting ducumentation. ( Or state statue, I am unfamiluar with yours). It will take a medical oppinion to dispute a medical oppinion, but I do not think you are at that point. What I think 1171 was trying to convey is. Wait untill you get the results from the dr. before worrying about it. If I may give you a bit of advise. Think carefully before signing with an attorney. Make sure you are doing what is best for you and yours. Take Care 8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins.
