Same injury, just three years later
Hello, I live in Illinois. And three years ago at work I tore my left meuncus (sp). I had surgery on it to just repair the tear. And just last month I tore the same knee cap (meuncus) as I did three years ago. My question is. I did receive a settlement with the first injury. However since it is the same knee again will they settle or was the first settlement a one time life time pay? This surgerythere was more done then the first. They did more repairs then they did three years ago.

I should add I have been working at the same place for 8 years.

I do not have a lawyer and would like to do it without one. Since this time everything is going pretty smoothly with the bills and everything.

RE: Same injury, just three years later
every thing is the same except the time and what you were doing when it happened.
comp covers only things that happen on the job.

an injury is an incident that happened at a certain time and not a body part.
comp does not cover your knee or your meniscus; it covers the event that happened 3 yrs ago at work.
the event that happened last month is different then the event 3 yrs ago and not covered by comp.
comp is not your health insurance.
it is the employers insurance and covers those actions that happen at work.

many confuse workers comp with their health insurance. it does not work the same way.
it does not cover individuals or parts of the body; it protects the employer from claims that happened on the job.
