The left knee is rated at 37%

The right knee is rated at 10%, the rating is the same as it was in 2007.

Whole body rating is 48 1/2%

I do not have the rating from the treating doctor on the lumbar spine as of yet.
I realize the rating of the lumbar spine will change the whole body rating.

Has the Left Knee been accepted also, or is that still in the works? I know there was a court order for treatment, I just don't remember you ever saying it had been accepted as part of the claim yet. All I can remember it was treatment ordered by the court.

But if accepted, I think the whole body rating with 2 knee's and spinal then fall under the 60/40 rule.

Lower body with spine at 60% whole body.

Bad Boy I did speak with my attorney about the left knee. According to him treatment was approved for that knee and the knee was accepted to the claim.

I know nothing about ratings, if 60% is a good rating or not.

With being on SSDI will the 60% rating (if that is what mine is) make a difference at settlement.

Today was the appointment for the rating with a doctor located in Wichita.

It was an adventure just getting to Wichita this morning, with this being a high pain day I had to stop twice on the way to the appointment to empty the contents of my stomach.

It was very difficult sitting in the chair answering questions, the doctor must have noticed because he told me at one point to take a break and get up and move around.

The appointment was 2 hours of questions & the exam with the report being sent to my attorney.

I spoke with the attorney today, he said the insurance company is wanting to settle and are getting their ducks in a row. They have requested the original benefits letter I received from Social Security Administration in 2007, they want proof I am on SSDI and receiving medicare. My attorney says this information is for the set-aside.

I do worry the recent neck injury may cause problems with the evaluation next week, as there are several things I simply can not do due to the neck injury. (Certian movements & activities start the headaches and shooting pain up the neck & into the head with the headaches getting to the severity that I have trouble being able to function)

Hi Bummer Knees,
It sounds like we have very similar injuries. I get the shooting pains up the neck and into the head causing SEVERE headaches also. Have you found anything that has helped your headaches or pain? We have tried several things and nothing has worked.I am in New Mexico. I hope the best for you. Smile

Boo when the headaches were at their worst there was little I could do to lessen the pain.

I did a routine of ice/heat massage and tens unit. Towards the end of the day I would take a Loratab 7.5

The tens unit did help the most.

I had a steriod injection of the lumbar spine a few weeks after the reinjury of the cervical spine. For a short time the headaches were completely gone, then returned but now are not as severe.
