RE: Work Related Stress/Anxiety
West Virginia specifically excludes mental only claims. You must have a physical injury.

§23-4-1f. Certain psychiatric injuries and diseases not compensable.

For the purposes of this chapter, no alleged injury or disease shall be recognized as a compensable injury or disease which was solely caused by nonphysical means and which did not result in any physical injury or disease to the person claiming benefits. It is the purpose of this section to clarify that so-called mental-mental claims are not compensable under this chapter.

I have Short/Long Term Disabilty, should I be contacting them to see if they cover it ? I have contacted personnel several times regarding my boss and her treatment of me which several other employees have witnessed.

You were in an MVA which means there was a physical injury. That is a physical-mental injury. Being stressed because of bad treatment by your boss is what is called mental-mental injury and is not covered.

You should contact the people at the Insurance that handle your Short/Long Term Disabilty, and ask if it's a covered item.
