I had a case closed in 2007 for bilateral upper extremities filed back in 1999. I was working at this time all I cared about is getting back my leave that was used up for all physical theropy. Of course, I never got my time back, I just received a small settlement. So now 2010, I had to file a new claim because I continued working with these injury. I had to call them so many times because my job challenged the restriction. The time frame for a case in CA lapse, so I had to file as a new claim. The w/c adjustor considered it the continue claim which I had future medical. I'm sure someone knows how it goes. Can that be right and why then did I have to file a new claim? I had surgery on my hand for tendon lasted and now I am in the process of having surgery on my shoulder on the same side. It was painful working all these years with the injury, and now one surgery after the other both on the right side. All this is throwing off the left side. Sad

you have to file a new claim when there as been a new injury. these are medical questions determined by a doctor.

I wonder why the w/c adjuster indicated to the QME doctor that this was a continued claim? In addition she provided all the information on the prior claim.
