RE: Got my settlement checks!!!!
Confussed:
I had bilateral carpal tunnel syndrome/repetitive motion. I had releases on both sides, but had to wait one year for the first surgery on my right hand and then then two years for surgery on my left hand (I am left-handed). By then, the hand surgeon said I had suffered permanent nerve damage to the left wrist since we had to wait so long before getting authorization to perform the surgeries. My 30+ year career as a medical transcriptionist ended - the hand surgeon said going back to what caused my problem would only make my hands/wrists get worse. Since I am now doing 100% clerical work, my hands are better but I do have permanent work restrictions, which my new employer has accommodated. I have a friend who has work-related carpal tunnel syndrome but her employer/insurance carrier did not give her a hard time and authorized her treatment (surgery) immediately. In fact, it only took her six months from the time of her claim until the time of her settlement. |

RE: Got my settlement checks!!!!
Genegene:
In the state of South Carolina, the attorney can charge up to 33 1/3% (which my attorney did), plus they can charge for additional expenses such as filing fees, deposition fees, court transcription fees for the hearings. My attorney even tried to charge me for postage and copying when he sent copies of reports to the insurance carrier's attorney, but the Workers Comp Commissioner would not approve those fees. The attorney has to fill out a form 61 which itemizes their fees and additional expenses, and this form has to be approved by the WC Commissioner. |

RE: Got my settlement checks!!!!
Needsmyhands....It was so nice to be able to read you are moving forward with your life. Just knowing that the nightmare does end. And there is a light at the end of the tunnel.....you just gave me some hope. I sure needed right now. I wish you the best...also hope you will stay around...or atleast check in and let us know how you are doing. Hope you got to take a break or some kind of a vacation with some of that settlement.

RE: Got my settlement checks!!!!
Nervous'83:
I prefer not to give my settlement amount. All I will say is that the temporary total disability payments I received, plus the settlement amount, which was based on my permanent partial disability percentage and future wage loss, was a six-figure amount. I was not disappointed in the amount that was negotiated for my settlement. After being on this website, I realize that I received more for my bilateral carpal tunnel than a lot of those with back injuries. What really helped my case was the future wage loss since I had to change careers due to my permanent work restrictions. I had been a medical transcriptionist for 30+ years - and that really helped my case since I could no longer perform those duties. The irony of it all is that I now have a job making what I was making at my former employer. |
