The decision is in from the Kansas Appeals Board
Earlier this year the ALJ granted medical treatment for the right hand, lumbar spine, and additional treatment for the right knee.

A few days later the respondont filed an appeal with the state work comp board.

Today I received the decison from the Kansas Appeals Board; We won on the back and right knee, but lost on the right hand.

One of the reason's given for the decision on the hand was due to there not being any record of my testimony on the hand.

It is suggested by my attorney that I testify on the hand. I told him I will do so but the courtroom needs to be accessiable for the hearing impaired as that is the only way I can testify, and the reason I have not testified in the past.

(I did not wait for the ALJ's decision on the hand and paid for the surgery myself, the doctor told me if I waited any longer for the surgery I would loose use of the hand. Work comp has paid for some of the therapy only on the hand.)

After I meet with my attorney a decision will be made on the next step to take.

May I ask? Why bother with the Carpal Tunnel, it's been fixed anyways. Plus, you and I know, it wont add any real dollars in the end come settlement, as your State has max limit on settlement correct. Unless there are other reasons. But, you know, you won 2 out of 3, and that is very good odds considering your case as it is.

Bad Boy I agree with you on the carpal tunnel.

My attorney is pushing on the carpal tunnel, but I really do not think it is worth the fight.

Going to have a sit down meeting with the attorney and discuss my case.

The judge noted in the appeals that I first complained of the ankle, back, and right knee shortly after I was injured but the wc doctor ingnored my complaints and no treatment was not provided.

Bad Boy I realize my injuries are not as severe as many on this forum but they are still there, changing the way I live.

Well, you are the boss, you need to ask or just tell them. But, wont this just delay things even longer then really needed when you can be getting treatment needed instead of the consent waiting?

And this sounds most important doesn't it? I be more worried about that statement then anything else. It has meaning to it. Most will miss the meaning of it.

There is not any hidden meaning to it Bad Boy.

The doctor I compained to is no longer providning care for wc patients.

When my attorney learned this was my first treating doctor he told me the ALJ was not happy with this doctor.

Bummer, what I'm saying is, you brought this up out of the blue here, with nothing to go with it, and leave no reason for it as of yet. What I'm asking is what does this all mean about this doctor. What does it have to do with what you wrote here is all. I haven't been able to put this with anything in the thread.

Hey, by the way, how has the treatment for your DDD - Facet Arthropathy been going? You never said that the Neurosurgeon mentioned Piriformis syndrome yet. Have any up-dates for us?
