Finished hearing, now what?
Aloha friends,

Just finished my hearing and am waiting for the decision. How long is the wait? My bills are piling up and I may get evicted in the next week.

Also I sustained a meniscus tear in my knee and I dont want surgery. What will my employer decide if I choose not to do the surgery?

you must have misunderstood the legal process. a check does not accompany the decision.
depending on the jurisdiction either party has a time limit -generally around 30 days- in which to appeal any decision.
only after the time for appeal has expired would compliance be required
delays in payment may require a penalty--again depending on the jurisdiction.

Im in Hawaii.

Their attorney admitted to mine that they dropped the ball on my case and would not be appealing the decision. So 30 days before I receive anything?

Also I have a injury and I do not want to get the surgery after hearing the nightmares on torn meniscus in knees.
What would the choices be that I would be offered?

1) settlement
2) vocational work
3) other

Finished hearing for what?

I will tell you this. Even though you don't want the torn meniscus repaired, it will just be a matter of time till you will beg to have this repaired. Yes, I tried to tough that one out too, just didn't work. It put me down, I didn't even want to walk anymore because of the pain walking caused. Yep, I went in and begged the Ortho to repair it. I know, likw anything, there is a 50/50 chance it will help. Well, it helped with the pain, so I was glad it did get done. Age is a factor in healing. If your 35 to 40 or younger, your chances are better too.

I have heard that some times they surgery makes the knee weaker. I dislike surgeries all together. But looks like I will have to consider it.

The hearing was to determine if I was to start getting work comp benefits. For 6 months I was on TDI and welfare as they investigated my claim. How long till a decision is made?

my dad had a torn meniscus and could barley walk and had the surgery 3 years ago and its like the man has a new long has no problems what so ever even runs a few miles a day like he used to do before he was injured said the surgery was the best thing he could have ever done for his knee..i would def reconsider having the surgery most are done with 2-3 very small incisions and are not very invasive at all

I have never seen or heard of the repair making the knee weaker. I have seen many in the last 10 years. Never weaker.
