RE: working at the same job after settlement
I can tell ya, I was injured and when restrictions were accepted it was a way different place.. I am a sales rep/deliver and was actually treated real well. I used to take on different tasks before injury but after none was offered. I had to show and build the trust back and then I was offered more work/money. I was happy but it took a tole on my body and am off work again for medical reasons due to previous injury.. I have followed all restrictions and dotted my I's and crossed my T's and stuck to the rules of the company.. I gave no reasons for them to fire me, now they want to buy me out and is not going to happen.. My lawer is praying they fire me, $$$$$$ ...

RE: working at the same job after settlement
See you are now considered a high risk to them, their work comp insurance has increased, and will stay at a higher level as long as you stay employed there. Proving any of it, can become impossible. Either you learn to deal with it, or your going to quit. They know this, and so should you. If you can show, your going to deal with it, it will be years before they back-off.

Well, they will push, you need to learn to the cheek, you need to learn to get tough skin.

Are you in a Union? If so, you should talk this over with your Union Rep. It sometimes can help. Your employer can't just single your out of work, if your able to work within your restrictions.

Recently I was told that if I could not work 5 days per week I had to leave. I found out that my job had nothing I could do for the 3 days I could work and they sent me home. FMLA has protected my job so far. The day after I was sent home, the doctors I work for threaten to leave the division if they did not bring me back and I was called to come back to work. I found out that I am only protected until my FMLA runs out and after that, my employer does NOT have accept the restrictions my doctor has given me. I have been on the job for 8 years and never had any problems until my injury on the job. My job will be posted and I will be replaced. The only good news is that my attorneys are wonderful and we are going to go after what we can get.

My employer's physicians have told them that my injuries were soley due to my fall on the job. I have 3 of their doctors on my side, and it's only my new boss who is giving me a hard way to go. He has never tried to work anything out with me nomatter how good I was on the job, and he won't. Get tough, stay straight and lean your rights. It's a trip!

if you are being discriminated against for filing a claim you can file a complaint.
contact the work comp commission or your union.
