employer has no workmans comp ins.
I'm from Texas, I was recently hurt on my job and had to be taken to the Dr. by my employer on the way there I found out that he doesn't carry workmans comp what are my rights as an employee? I do have ins. and my employer paid the $20. co-pay that day I just don't want to be stuck with any residual bills from this injury. I don't want to cause any problems for my employer but I want to be treated fairly in this situation also.

those texas workers without insurance coverage are free to use the civil court to obtain just compensation for their injuries.

Also from Texas-I'd be willing to bet your private IC will kick back the claim for payment since you were injured at work. WC insurance or not, private insurance is going to fight it if you told anyone at that Dr's office it was a work injury. Lawsuit-it's in the air-how much is your employer worth?

The tree of liberty should be refreshed from time to time with the blood of tyrants. We have three in office right now-obama, holder, and napo!

RE: employer has no workmans comp ins.
Texas is one of the few states that do not make employers have WC coverage. Your personal health insurance shoudl cover the injury.

This is one of the few times that I suggest anyone in texas consult with an attorney.

Take Care

8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom.
