Benefits for Temporary Total Disability (TTD)
The percentage of worker's wage paid is 66 2/3. For weekly payments, the minimum is $154 (20% of SAWW or actual wage, if less) and the maximum is $577, 75% of SAWW. The maximum period of payments is the duration of disability. WC benefits are subject to UI benefit offsets

TTD seems to be payable for the duration of Disability. Hum.... Talk to your Attorney ASAP.

I believe the 520 week cap is for Supplemental Earnings Benefits.

Yes, Kate, your are correct...the 520 weeks is SEB, not TTD. We had discussed so many of these things in the pre-trial, and I totally forgot about SEB. Thank you, Kate!

Huey, please remember an IME doesn't get you appointments. They don't work that way. They offer only a medical Opinion. And after that is said in their report, anything they may suggest is still and only a medical opinion. Then the IC can use it, or not use it, but they IC doesn't have to go by what the IME states. You can ask your doctor to put a request in writing for the FCE. Ask for a copy of it, and then pass a copy onto your Attorney. Doing it that way just may help better.

Now I had several FCE's. In fact they were used to monitor my progress, and then the final ones were used to say what I could and could not do or perform in the work field then.

If surgery has been suggested, a FCE could be performed sometime after surgery, to use as a tool for refference, but then a final one would be needed to see your progress, and state where you will fit into the work field.

Reply's are intended solely for informational purposes. They are based on personal opinions, experience, or research and are "not to be taken as fact or legal advice", otherwise, always consult an attorney or a doctor.

Thanks for all your comments and assistance! It sure is nice to have people who listen and explain things instead of talking down to you!
