as you all know i was placed at mmi and sent back to work..well my second day(today)the pain was so bad i had to go back to the company dr and hes taken me off work again and refered me to see my original dr who did my surgery not the one who removed the hardware and released me back to work dont know if this is a good thing or bad thing but the ppl at work couldnt be nicer and more understanding so i gues im lucky to have that in my favor...so does this mean my ttd continues??..is this considered a whole new claim since i was released but with restrictions??..really confused right now and in alot of pain was so excited to be able to go back to work and now this..maybe my back is worse now than my dr anticipated it being..just dont understand how he put me at mmi without touching me or anything after my last appt..but whatever ill stop ramblingSmile

I am only guessing that your state is the same as mine in respect to this situation. When I was sent back to work. My monitary benifits enden, but when I was taken back off work. My monitary benifits started back. I do not think it will be considered a new injury. It is the same injury.

8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom.

you need a medical opinion on this.
if it's a new claim, then you'll be entitled to ttd.

if it's not a new claim, then there is an issue as to whether you are mmi or not
if you are not, then you are entitled to ttd.

these are issues that may have to be decided by the work comp board based on medical evidence as doctors often disagree.

why do you think it is a new claim/injury?

oh i dont think it is a new claim/injury...was just wondering why they sent me to the wc clinic instead of the treating dr first

probably SOP for all medical issues-- they leave it up to their clinic to make the call especially when it's not obvious.
