I'm in CA. Today, i met my neutral doctor for my back pain. I hurt almost 2 years ago . He requested special treatment before surgery; however, i declined because i had more pain after 3rd epidural. I could walk and drive with less pain (L5~S1 was 5mm. PD couldn't decide back surgery due to my age, 30 year-old). However, after 3rd epidural, i couldn't walk, move, and anything. I went ER and my RX was changed 4X stronger. I'm still crying all night due to pain. That was a reason for surgery. I requested oriental treatment as acupuncture instead of the surgery. My pain management doctor also requested back surgery and i requested oriental treatment. The neutral doctor didn't say anything about the words and said as the case will be closed. He marked as we don't need to meet next time. However, he said future medical will be opened. In this circumstance, how my case work? When the case completely close? How pay my additional treatment cost? Please advise me.

we need your state please,what does your pain management Dr say....many of us can relate to the up all night with pain...do you have a lawyer?
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

Once you refuse treatment it closes your case. Unless an attorney or you can prove, and I say can prove other treatment will work. Good luck.

If it was said all options had been tried, and surgery is the last thing to try, and you say no to it, the Doctor/Surgeon then puts you at MMI. Meaning (Meet Medical Improvement). As saying there is nothing else to do for you. They only rate if it is requested.

Bad Boy has Explained it Well, You Declined a Procedure and a Important One, and They are Basically Telling You that Unless You have Surgery to try and Help Yourself, Your Case is Closed, but Medical will Continue for You to See Your PM Dr. But if You were Receiving Monetary Wage Replacement Payments They will Stop. Sometimes You have to go with what They Think is Best, Unless You get a Second Opinion from a Dr. in the Same Field that would State that Surgery is not the Best Course. At that Point You could Petition the Courts for a Hearing for the Judge to Decide which Dr. They Feel is More Credible, and if Done Correctly by Your Attorney if You have One, Your Monetary Payments will Continue while the Case is in the Hearings Mode. If Your Dr. is found More Credible, You will have Won and Your Case would Continue. If You have an Attorney get Them Involved Quickly, If You don't have One, You May want to Get One and Soon. Best of Luck.

you have 2 cases: one legal that the court uses and one that the carrier/employer use to pays benefits.
the legal case will close when your award is given and disputes resolved. your claims case will be open while you are getting treatment or other benefits are being provided. limbo: you come back with baggage. the more you deny it, the more difficult acceptance will be. if you truly have regrets then re-join honestly, re-start fresh. |
