Court date but another lawyer goof
Hi All,

I do have a court date for May 20th at 9:00am unless my lawyer doesn't fix why we're going to court I'm not going.

We were listing 4 items, my lawyer left off two.
1) Payment for unauthorized Dr. visit
2) Medical treatment
That's what he put on for the court docket
This is what he left off
3) TTD
4) Change of treating WC doctor

We talked for about 20 minutes on the phone. I want those changes in writing.

Oh well, my husband today bought me a vase. It replaces the one our kittie broke while we were camping.

When I have gone to court the judge will ask what are the issues, at this time the attorney can add or drop something.

I know this because this has happened to me, I also had the TTD left off but the attorney added it in court. Remember if you don't get paid the attorney dosen't get paid. I think the problem has something to do with the office staff.

I want it in writing, re-submitted before court, I want a copy of that. My first lawyer left it out, I didn't catch it. These were things I personally talked to my lawyer about. I'm not happy, again.

Builder, You are absolutely Correct in Wanting it in Writing!! The Most Word I have Heard Through 15 going on 16 Hearings, even when in Writing at Times is "Hearsay"!!! My God do Both Sides Love to Use that Word! When Hearsay is Heard, it is Usually Followed by One Side or the Other Asking for the Judge to Order a Deposition or Filing for Testimony of the Issue!! Document, Document, Document, and You will always have the Answer in Writing to Back Up any Hearsay that May be brought Up at a Later Date! My Very Best to You, and Good Luck at Your Hearing!!Wink

Well, I don't see any reasoning behind leaving things off, as it is no extra work to do it all at the same time. If waiting for the Hearing then bringing up those issues will only promt another hearing, and waiting even longer once again. If that continues you will go to hearing after hearing, instead of getting all done in one hearing or two.

BB I have an appointment with our attorney today.

Going to discuss the appeal.

I see the surgeon next week on the knee that was replaced.
I imagine the insurance company is bitting nails over this one.

I basically told my lawyer that unless I received something in writing that the omitted items weren't going to be on the docket BEFORE court I wouldn't be there. I guess he believed me
