IME vs my Doctor
I actually had a scheduled loss of use by my doctor and then had a IME, the IME was actually a higher percentage, my question is this, which will they side with ?? Normally it is the opposite, the insurance company is the lessor.

the comp court will use whichever evidence is the most persuasive.
the parties can negotiate between the two just as if the ratings were reversed.

Generally a private physician has little or no knowledge of how to arrive at an Impairment, offering the usual SWAG report. An IME Dr. tends to do them all the time and so has the requisite training.

depends on the state but generally the comp court or the commission will have final approve of any finalization.
