I WILL TRY & EXPLAIN MY PAST POST
I WAS GOING TO SIT ON THE END OF OUR OUTSIDE PICNIC TABLE AT WORK, AND 1 OF THE 2 PIECE'S OF THE WOOD SEAT, CAME APART AND HIT ME ON THE HEAD. I WAS OFF OF WORK FOR SEVERAL MONTH'S, (AND RECEIVING W/C). I WANTED TO KNOW IF I CAN GO BACK (2003) TO GET COMPAINSATED FOR PAIN & SUFFERING? MY NECK IS REALLY SCREWED UP. MY LAST MRI SHOWED DAMAGE, AND I STILL CAN'T MOVE MY HEAD ALL THE WAY TO THE SIDE, OR SLEEP ON MY STOMACH, ETC. WITHOUT PAIN. MY MAIN QUESTION IS: CAN I GO BACK ON MY EMPLOYER IN WISCONSIN FROM THIS ACCIDENT, TO RECEIVE MONIES, FOR ALL THIS? THANK YOU

cannot sue for pain and suffering,just med cost to get fixed and back to work......
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

Hi Christy....I also suffered a head injury back in '03. I wahcked my head so hard on the parking lot I thought when I looked at the flood lights that I had died. Severe neck pain. I was told that the neck pain would go away as it was muscle strain. i worked through the pain and concussion. They were wrong . I had suffered alot of damage to my neck and since they neglected to even order any tests or put me out of work when I sufferd this injury in "06 involving 5 body parts an MRI of my cervical spine was done and what a mess. Yes it probably came from the fall but too many years have passed to claim it now. The Judge has picked up all 5 body parts. My cervical spine is listed as an aggravation of pre-exisiting DDD and spinal stenosis. In my state if you haven't sought medical treatment for an injury in 2 years a new claim has to be filed. Talk to an attorney. I believe with occupational disease and aggravation of pre-existing condition sit's the date you realized you suffered this. CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

Christy did you settle the original claim through compromise and release? Did you ever have a permanenet impairment rating done? Were you released for full duty work and or released from medical care? When is the last medical treatment you recieved that was paid for by the WC IC? And last but not least what state were you injured in? I seen in the other post that you moved to Montana but the state where you were injured is the one that dictates the answers to your questions.
WC is a no fault exclusive remedy coverage that NEVER compensates for pain and suffering. Have you considered filing for Social Security Disability if you are unable to work? CHRISTY51, my best opinion for you is as follows. Do you know your Work Comp Claim Number? If so, you can contact the State where injured, and then take it from there. You can ask them everything you like to know, even what the Statue of Limataions are. If you know your claim number, in the site below, you can also check your claim Status.
