WE need help : Update
Well hubby has gone to his third of the 9 rehab appts and they only did his back .but had to cut it short because he was hurting from the day before. So he has to go every day this week to even get most of them in.
Now i go to the mail a few min ago because i forgot to check it yesterday and what is in there.. a RME for august 23 over off of randol mill rd in arlington, tx... not sure if this is good or bad .. i am thinking bad... that the adjuster is trying to force him back to work before anything is really done ...can anyone tell me what they are going to do at this exam? hubby and his boss are supposed to be calling the adjuster tomorrow to try to give more details on his job descriptions...being that for each customer there are different things to be included.. so maybe she will get the picture better or a light bulb in her head will come on... We hope she does... Another question in my mind is how they can not put at least his arm/shoulder in when it was documented at the first Dr the chiro and he did do xrays on hubby's shoulder,back and knee and rt arm not sure about the left hand or knee yet hubby's hard to get info out of sometimes....and the chiro was going to send him for an MRI and this Dr isn't doing anything ... i am so maddddddd... and my diverticulitis is acting up with all the stress and no meds to ease it and i can't sleep worth a poo ... might get 2-3 hrs and once i wake up it is a while before i can get anymore and that just throws everything off ... |

Call the Dr (chiro) office and get a copy of his report sent to you so you will know exactly what is on it...its not to early for you to learn that you should always get a copy of your husbands Drs visits sent to you after each visit or pick them up after a day or so make at least 3 copies always keeping one in your files at home,a file in the car and a file that will soon go to a lawyer(if needed)You are going to have to learn to calm down and put your big girl panties on, your trip in the workmans comp world has just started and it isnt anywhere near finished.You are going to have to be your husbands advocate if he isnt able to because of a surgery or anything else that may come up.We are all here to help you but you are in the lead.
Learn to document everything,keep a notebook and write down everything said to you,every phone call what time and who you spoke to.That notebook will become your best friend....write down your husbands meds and if he has a bad reaction write that down also.... You can do this WC can kill a marriage or it can make it stronger dont let it kill yours.. ;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

I TOTALLY agree with Jayne.. Workers comp. is like no other at all... Every injury is different and most W/C adjusters don't care, you are a "problem" to them so to speak. I would defintely calm down, and before you go to an appt. have you questions wrote down on a piece of paper and ask the Dr once you see him. ( thats what I do ) The RME is most likely to determine his "status".. As far as the PT visits, mine were spaced out more than everyday... I would calmly ask if he could space them out due to the pain.. Normally the PT facility will do what is best for the injured worker.. Hope this info helps but you defintely have a long way to go... I've been injured 4 months now from a herniated disc, and have done PT, medications, epidural steriod injections, none has worked yet. Now I have a nurse case manager that oversees my treatment.. Trust me when I say you have a long way to go... I would DEFINITELY get an attorney to try and get your husbands TTD checks to continue since he cannot work... My attorney has done GREAT things for me and remember they are one your side.. But don't wait too long becuase sometimes if an attorney sees a "claim" as a "problem" that has already started it will be hard to get one.. Good luck, and I pray all goes well.. |

I have gotten the copies of what was in his file from the current doctor. We are planning on going tomorrow to get copies from the first doctor the chiro. I do have my big girl panties on .. thank you very much ... but any stress aggravates the diverticulitis and lets just say i get stabbing pain in my abdomen and live in the bathroom ... I have also written down in a notebook everything i could remember that the dr said or asked at the dr visits with the current doctor.. and the reason we have to go all week i forgot to put in this posting is that they run out on 7/23 for some reason and i wanted to make sure he got most of them in , just in case they said something about missing any of them. You would have to read the other post to get more info but WC I/C is not denying his back so he has been paid up to 7/11 just denying everything else saying is was not done in the course or scope of employment.The only phone calls have been 1 from the adjuster at the beginning and a couple to his boss to see if there was a written job description.

Normally you only hear from the adjuster the one time at first and thats to get a statement of how the injury occured, from then on the Dr's office will call you or sometimes the I/C will have someone there call and inform you of the services they have approved. As far as when the PT expires, I never heard of that before... As far as them denying everything else, if it wasn't documented it will be denied unless the injury is interferring with the other extremities / causing problems... He should still be recieving TTD payments if he is still under treatment and the Dr has not released him on any medical restrictions.. That being said if he can do light duty and his job has no light duty, then the I/C will continue his TTD payments.. W/C is like NO other... So just prepare yourself for a LONG journey ahead... Once again I would STRONGLY suggest you do get an attorney ( especially to fight that all injuries are taken care of ) bc if you wait too long and there is alot of ( mishaps ) NO attorney will want to take on your case because they do not want to deal with the previous "problems" that have concurred b/c you let the I/C walk all over you... I've asked a friend of mind here that used to be a paralegal and they stated at this point and time that if you asked them to be your attorney they would decline services... So i would advise you do something before its too late... I would document EVERYTHING in that notebook... I started writing everything down in mine due to I had a bad feeling my employer was going to fire me b/c of my injury due to the way he was talking / acting.. And I was right... So remember to have a clear mind at all times when talking to Dr & write down everything.. Stay calm because I can assure you this is only the beginning.. |

i have been trying to write down everything i remembered from all 3 of the visits to this dr and getting hubby to tell me what goes on in therapy also.
I am not sure either why they would put an ending date for the therapy. As for the partial denial not sure either .. when we filled out all the paperwork for WC and I/c we put the same thing down and included all of the areas that they are partially denying .. as for injuries interfering I'm not sure.. as i said injuries are to back- mid and lower, rt shoulder, elbow and knee and hand (no strength) and left hand and knee and neck. And those areas were all listed on all forms. They are sending TID's just got the current week today, but since they did not deny the back st/sp as listed on paper from IC that is why they are paying. Dr has on paperwork said he can work but with heavy restrictions on lifting, walking,pushing, pulling, standing,climbing and crawling and sitting...to which are daily things in his job. And since he can not do these things and can not go without the muscle relaxers and pain meds work does not have anything for him to do, he has to drive and he can not drive because if he tries to hold up his rt arm as to drive it hurts too much. I just want to find another dr... i feel like this was my fault by going to this dr..But if you can only change once i don;t want to make another bad by picking another not so good dr. I thought about having him ask the adjuster if he can get a second opinion but then that would be a dr they chose and he wouldn't be on our side. Has anyone heard of a place in hurst,tx off of harwood rd?called Texas something.... my sister mentioned it because she went there for her arm about a yr ago? it's she only said the name once and i can't get a hold of her to ask again yet and she said her treating dr was at a care now and they just sent her out when she needed other dr's to look at something and they sent her to this place and she was very happy with them they did the rehab and hospital next door the surgery ... as soon as i get her again to ask i will put up the name .. . But she said something to me about my hubby ..he won't be presumed to be a wimp or as she said a p---y and i know this and i keep telling him if he does not speak up when they are making him hurt they won;t know how much... he thinks he's doing what he is supposed to do as a man and i have told him it just makes them think he is not hurt as bad as he is ... something else i may have not mentioned not only do i have him to worry about i also have my 75 yr old mom who is not in great health and after her heart attack has not been like her old self.. she won;t go out of house without someone else except about 2 blocks away to the little store she is afraid now. . something she never was ...she was very independent up till then and since my sis is too busy having to work 2 jobs and my niece is prego and has a 1,7,and 10 yr old she doesn't have time but once or twice a month to come help out .. so that leaves me to take her to her Dr appts and to the store and what ever else she needs..so when i get upset and rant on here it is because i am being pulled and i am doing my best ... so sorry if you think i am whining i really don't have any other support behind me to help me deal with all this. |

As far as switching Dr's I would ask a/b your state, but here in TN its once and thats it, unless a Dr refers you to another for a specialized area ie nuerosurgeon, chiropractor, etc.. As far as your hubby in PT, tell him to only do what he can do... I tried to "exceed" what the lady was wanting me to do and she said don't over do it and hurt yourself, and also she had to write down a "daily progress report" of my workouts so if I do X one day and a smaller X the next time and so on its looks funny... So tell him to do only what he can and thats it... Its not work reinjurying himself or making his injury worse.. |
