I went to my CCH a week ago and the judge sent a letter to my DD doctor requesting a LOC from the DD and the DD changed my MMI date and increased my IR. Is this final?

I was initially awarded 7% Impairment Rating On my Shoulder and Back Injury. I contested it because the DD doctor did not have all the medical documents to make the decisions that he made! The hearing judge agreed and sent the dd doctor a request of a LETTER OF CLARIFICATION along with the rest of my medical records and the report came back with different impairment rating and mmi date! the new impairment raiting is 16 %. you qualified for sibs when were given your first rating.
there is much more to the process then the judge getting a response to the LOC. a medical opinion is just evidence; docs don't have legal authority to order benefits. the judge has to approve the rating and issue their decision. either party can appeal the courts determination. |
