What if you had a paid increase. For example you settle when you was making $20 pr/hr then you reopen your case & now making $25 pr/hr do you still get paid at the old rate?

I just received my IME report, in the report the doctor claims that the records he received from my surgeon claim I have a 75% temporary impairment. In his(IME) conclusion he states that my degree of disability is a "total 100% temporary disability" and that I have not reached MMI . My questions are 1- Has anyone ever heard of an IME report claiming my degree of disability is worse than my primary doctor(surgeon)? and 2- How long will they give me to reach MMI ? Its been 2yrs and 7 months since my injury. (NYS here) Thanks for any info

how partial your temporary disability is, is not very meaningful unless you have an employer willing to modify your job.
very difficult to predict what opinion any doctor might have in the future about your condition.

Well I have already received my termination letter from work so that is not an option. The IME report says I am unable to return to work in light duty or regular duty capacity. He also recommends a referral to VESID for job retraining. My primary doctor has not suggested this to me as of yet. It just seems kind of funny that the IME is helping me out more than my doctor .

it happens.
there are a thousand times more claims that go thru the process without problems then the few that have to come to an on line web site for help.
don't judge the whole system by a few.

in 2010 New York alone had 122,000 comp claims filed.

I agree, I'm not judging the system by what others write on this forum. I am just happy the way my claim is being handled. If I do judge the system at some point it will be based on my personal experience. thanks for all the replies

I have another question, when I had my injury I hurt my neck,back and wrist. I have to herniated disc's in my neck, 1 disc in lower back(had surgery already) and have moderate carpal tunnel(Doctors are suggesting surgery). All injuries are on the same WC case#. If a settlement is offered will it be based on each body part injured or a % of loss overall ?
