Help Please!!!!!
My husband was injured in a motor vehicle accident on 6/20/2011. He was driving an eighteen wheeler, when an eight foot trailer came off a guys personal vehicle and into his lane. My husband suffered a closed head injury. He was off of work for two weeks in which he immediately received a workers comp check for two weeks on July 5, 2011. He returned to "light duty" on July 5, 2011. He receives 766.00 per week from WC when he is not working. My husbands work was suppose to send the last three pay check stubs to their workers comp insurance to ensure my husband gets paid. His first check with his company was only 44.00. He has not received workman's comp since he went back to work. The workman's comp adjuster finally told my husband just to send copies of his pay stubs, because his work is refusing to send the appropriate documents for my husband to be paid. We hired an attorney for the accident, but now we are thinking we may have to include his employer in the lawsuit. My husband has been seeing a workman's comp doctor who actually told us he is getting pressure from the employer to release him. My husband saw a neurologist yesterday and his work called 4 times during the appointment to see if the neurologist has released him yet. We are about to lose everything! We bought a new house and had only made one payment on it before the accident. We are too the point that we do not know what to do. Any suggestions would help. My husband's head is still bothering him, but he is to the point he is going to lie to be released back to full duty. ( he went from 1500 a week to 766, now to 44.00) I have applied at about fifty jobs and have not received a call back yet. I am a full time student and we have three children. It is not workman's comp denying the pay it is my husbands work refusing to do anything. When my husband was off of work he received his checks, now that he is back at work he is receiving nothing. What should we do and when he does receive workman's comp checks will they go by what he makes or what he brings home? The workman's comp adjuster is working to get my husband paid hopefully all three checks next week, but until then what do we do?

first take a deep breath and know you have come to the right place....is your husband able to drive his rig safely? if not have his doc get him off the road....second if his job is making his head injury worse get his Doc to get him home.....Have your lawyer(or you can) call your morgage company and let them know what has happened they will work with you they dont want that house back on the market did you happen to get disabilty insurance on it? or on your other bills? as for your collage go talk to them and get some hardship grants and loans dont forget foodstamps in this mix..local churches..Salvation army and the Red cross...
Best thing just dont panic....you must be the port in the storm for your children and your husband....now give us your state please ;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

Do you have a savings account? Do you have a 401k with his employer? You can take a hardship withdrawal without penalty under the circumstances you state above.
If you have descent credit, do what you have to do until you can weather this storm. I tapped into my 401k when I became injured. The big thing is to BE SMART and use the resources available to you. Surely your husband has some type of Retirement account making approx. $78000 a year ($1500 a week gross) 2011 Lexus Convertible |

My husband is not able to drive his truck, and has been off on a doctor's not that continues until August 2, 2011. His doctor did release him to light duty at work in which he is working in the office. He is only allowed to stand for 2 hours a day, so that have him doing secretary work. He is handling his light duty responsibilities okay, but he is being harassed by other employers about returning to work. He spoke to his boss about it, and his boss ignored him. I did speak to the mortgage company and they said ohh we are sorry for what is going on, we can extend your payment by ten days. We did not get disability insurance, through the mortgage company, (all of our insurance fees are rolled into our house payment) My husband's job does not offer disability, but the companies workman's comp insurance has been helping us with all the paper work. I have went to our church and since it is summer they do not have emergency funds. I applied for food stamps a week after the accident and they have decided that even with the loss of income my husband makes too much money while on workers comp to qualify. I tried to speak to them again, but they said we had to wait thirty days to make sure my husband does not receive any funds. My school has already been paid for and I am okay. I work as a volunteer for a Mental health clinic and they are letting me work 5 paid hours a week. But it does help it ends up being 300 per month. We live in Texas...... We HAD a savings account, but unfortunately we emptied out our savings account placing a hefty down payment on our home. My husband was in the military and began this job a year ago. He does not have 401k with this company, so we do not have any money to draw. We do receive information about retirement, but I am not sure that he can draw any of it, because it is through Disability and Social Security office. The oilfield companies in our area do not offer the perks of other employees. Can you try for disability with the Social Security Administration even though you are on workman's comp? |
