![]() Pote: a doctor can't say there will be future injuries and problems and they will all be due to this work injury and thereby tie the employer to bear the burden of all the consequences of conditions over which the employer has no control. That is contrary to work comp law and legally won't hold up -- it's not a medical opinion it's an incorrect legal one. If there is a future injury to the same body part -whether on the job or not-- that one is going to be repsonsible for the new treatment -- not the 15 year old work injury. ![]() Most states have laws that say something like: "the work injury has to be the proximate cause" or "primary cause" or "predominate cause" or "more the any cause". ![]() A lot of things can happen over 10 or 15 years and if/when you need surgery it would be naive to expect a quick clear approval from an old comp claim. If it's something like hardware removal or to correct a poor surgical result there probably won't be much problem otherwise not a slam dunk. ![]() does that help clarify what I meant and why i answered the way i did? |
