CT workmens comp said you have one year to claim an injury and three years to claim a repetive motion injury. What exactly does that mean? I have been going to a Dr. for Tennis Elbow for a year and just now he said he thought it was definatly caused by they type of work I do. I never really pushed the issue before. I never reported the injury a year ago because I just went to my Dr. I didn't know if it was work that caused it or not. Now, because of all the injections and pain I want to file a claim. Will they not approve the claim because I didn't say anything about my pain a year ago? It is caused by repetitive motion at work. I did file a claim and now I guess I play the waiting game. They have 28 days to respond either way. Plus if I'm ever out of work, can they replace me? I am in a Union. I am going to contact them just so they know I have filed for WC.

tennis elbow condition is generally a repetitive motive injury.

I thought so but I wasn't sure. Reason I am asking is that my manager hates my guts and she was acting really funny when I told her I was making a claim. I have mailed off the papers and will have a return receipt for them. So.....there won't be a question of when I filed.

unless the employer is self-insured the decision about comp beneftis will be made by the insurance carrier.

How do I find out that? Doesn't WC of the State have a say in they except the claim or not?

I have insurance through my job is that what you mean? They have been paying for my visits to the Dr. but that will change when they except the claim.

Guess I shouldn't hold my breath. I thought it was just a cut and dry outcome that it would be covered under WC. Will they use the fact that I have been seeing my own Dr. against me?
