Just Received Great News, and Wanted to Share that We Can Fight and Win!!!

Hi Everyone!! I am going to try and Keep this Short, and Please Excuse any Mistakes, I started the Opana ER Today, and Stopped the Methadone, so I'm Feeling a bit Odd, But I had to Share this Victory with You All!!! Many, Many Times, I have Said : "Hang in there and Keep Fighting, don't let them Win"!! Well it Really Does Work, and Here's a Perfect Example:

Most of You that know Me on Here know I have been Fighting My Employer and w/c for going 5 Years, and the Main Issue that Started this Battle was the Fact that I was Being Underpaid by My Employer, as they Calculated My Average Weekly Wage Incorrectly. After 2 1/2 Years of Litigation, it was Found by a w/c Judge that I was Being Underpaid, not at the Figure that Myself and My Attorney feel and know is Fair, but Kind of in the Middle, Hoping Everyone would be Happy on both Sides, which of Course We weren't, and Appealed. I Received in Penalty Money, Interest, and Back Pay Approx. $14,000.00 which Helped Greatly, and We will be going to the Commonwealth soon to get the Rest, but that's another Story!

As Required by Law when You are Receiving SSDI to Supplement Your TTD to get You to the SS 80% Wage they Pay I Made an Appt. and took All of the Info, Required to the Local SS Office Serving My Area, along with the 52 Page Judges Decision. The Worker there Made Copies, and told Me that if there was anymore needed from Me, or if Anything would change as far as My Benefit, I would be Contacted. I Left knowing I did Everything Correctly. TEN MONTHS LATER, I Receive a Letter Stating that I have been Overpaid just a Tad More than $10,000.00 from SSDI, and they wanted Their Payment, and My Monthly Amount was and has been Reduced by More than Half!!! I Contacted My Attorney, and He told Me to Request a Waiver, and Explain My Reasoning for it, and they will Set-Up a Face to Face Meeting at the Local Office, and if I was Denied, I could also Ask for a Mediator that has not seen My Case go Over My Reasoning, and Make a Decision, and they have the Power to Over Rule the Original Decision.

Well as You would Guess, and I Mentioned on Here I was Denied, Asked for the Mediator who by the Way Agreed with Me 100% then Looked Me in the Eye and told Me even though She Agrees, I still am being Denied the Waiver, it's Her Job to Protect the "Communities Money", and then I went onto Explain that I am a Part of the Community, and Part of the Money She is watching is Mine!!!

Now I was Approved for SSDI on My Own, without My Attorney, so I took All of these Steps Myself with My Attorney's Suggestions, and I also Contacted My Senator, who by the Way has been in the News a lot Lately, Sen. Murtha. My Last Chance is to Ask for an ALJ, (Administrative Law Judge) to Hear My Case, and Make a Decision, and My Attorney now became Involved, and by the Way told Me there would be No Fee, He Said He sat many Months waiting for Something to happen in My w/c Case getting Paid, the Least He could do was Represent Me at the Hearing, which is 60 Miles One Way for Him, and 30 Miles away for Me. I Applied, and My Attorney said it takes 12-18 Months to get a Hearing so set back and wait, it will be a while! That was a Little over a Month ago.

In the Mail Yesterday I Received a Letter from the ALJ Offices Stating that they had Read Over My Case, and there was enough Evidence in there to Make a Decision without a Hearing, and He Found that I Had Followed all of the Laws, and Decided that it was not My Fault that My Employer Paid Me Incorrectly, and not My Fault that it took 10 Months for a Reply, and My Explanation of Why I felt I didn't have to Pay Made Perfect Sense to Him, and He Granted the Waiver, and I No Longer Owe the $10,000.00 Plus!!!!

I have been Fighting this for Over a Year, while at the Same Time Fighting w/c and this Dam* Pain, and the Depression that comes with All of that, and Praise the Lord, I Actually Won Something!!! I want You All to know this Because it Does Pay to Fight, if You feel You are Right, sooner or later Someone with Sense will See Your Battle!! Sorry so Long, but I wanted to Make Sure All of You, especially any Newbies Fighting, that You Can WIN, and the Sun does Shine Sometimes!!

I am very HAPPY for you!

In the past I have worked as a volunteer intake worker for Social Security Disability and many of the families I have helped would find they had been overpaid and needed to replay SSA back.

I have always told these families to complete the appeal paper work.

I've had the same thing happen to me, when my daughter was on SSI she was over paid, I appealed and won.

Thanks Everyone!! It was a Major Relief to Win, but I wanted to be Sure and Post it Here, because when I came Here as a Newbie, I was taken in, Helped along, and Learned a lot Here from so Many!! I just want to Pay it Forward, and let Folks know that no Matter how Much seems to Pile on Your Shoulders, if kept in Order, and Fought One at a Time, We can Win what is Ours!!
