Kat, Sorry for Not Answering Sooner. After My Surgery, I Fired the Firs Shot in My Case because I wasn't being ,and I'm Still not being Paid the Correct Wage Replacement Amount. I was sent for an FCE (Functional Capacity Exam) First, Followed by and IME. My Attorney and I got Second Opinions on Both, and the Ins. Co. Paid for them. I was also at the Time trying like He** to get Re-Operated on and Back to Work, and I saw a Total of 9 (Both Ortho. and Neuro.) Surgeons and by them Referring Me from One to the Other, the Ins. Co. Paid for those also. At that Point the Last Dr., (The Re-Surgery Specialist for the Pittsburgh Steelers), referred Me back to My PCP who Referred me to the Pain Management Dr. who Controls My Case now, and I didn't Pay One Dime for any of it, because of the Referrals! Now I don't know how Your State handles situations like this, but it's Sure Worth Looking into!! Actually Your Attorney should be Looking into this on Your Behalf!! Stay on Your Attorney until they Either Act, or Step Aside and Allow You to get Another!! I have been Very Fortunate to have a Great Working Relationship with My Attorney, and it Burns Me when I See Folks like You having to Fight to get Your Attorney to Act! My Very Best, and again, Sorry so Late!!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

As I stated before, this attorney is my second one, as the first one didn't even answer my phone calls. The first attorney also expected me to pay for the medical opinions prior to my hearing back in 2007.
I don't really know the law here in WA state regarding who supposed to pay for second opinions, but both attorneys told me, w/c has to approve. And they don't since 2006, they deny pretty much all medicals. They pay only for IME's and PCE's(same as FCE)what they keep ordering. And recently they paid MRI on neck because their assigned clinic recommended, but not when my own doctor requested.

If I try to change attorney again, that would be my third and probably he wouldn't take my case without strong medical evidence in my favor. So here we are, back to square one...can't pay for them

Thank you again for trying to help. One thing...you were really lucky w/c paid all your medical cost including second opinions so you can keep fighting.

Regarding how we supposed to survive until ssdi decided, nobody really cares. My state(WA) must be the most inhuman state where politicians think everyone makes as much as Microsoft or Boeing emploees and all the population cares or needs is more bicycle lanes. We were the first ones nationwide to come up with the idea of tent cities. Lots of people keep moving with these huge tent cities, from churches to churches where they are tolerated for a few months.

I was lucky, before all my savings were gone, I bought this 27 feet used travel trailer and a tiny parcel in this private camping club, where the living cost is minimal. I like it here, very pretty and safe, except some wild animals, like bears, cougars etc.
