florida man construction worker.12-22 spinal fusion with instrumentation.doctor just told carrier he will never clear me for full duty just light duty forever.employer sent me home month and a half ago from light duty,i think its cause i hired attorney.ive had a deposistion at that time carriers attorney said they will get me fixed and now ive had surgery.had urinating issues due to nerve damage from disc before surgery now 11 days after surgery im cathetered cause cant urinate on my own,seeing urologist tomorrow will know more.question is i cant do what i used to its proven work related ive had surgery i want to settle for some $ and leave this state i hate it.should i try schooling ? can i get help with that? any ideas? denmantragic@yahoo.com

If you end up at MMI and there is nothing more they can do for you, and you receive a permanent impairment rating, you could receive an award settlement. I am sure after the surgeries you have had and not being able to return to your line of work that they will offer you some sort of Voc. rehab to get you to find a job within your restrictions.
This will not all happen overnight as you know. It took me a year without surgery/lawyer to get a permanent settlement which was only 10 % and I had to change my line of work. I am one of the few that are lucky enough to return to work, but struggle so severly everyday. If not for the meds. I would not be able to. Seems your injury is less than a year now from what I have read. My brother had a spinal fusion and ended up with so much scar tissue that he never returned to work at all. He is only 45. But on SS since 35. I lived in fla. too and hated it for 9 yrs. That is where my cousin just passed away in. You will be able to leave that state. Nothing says you need to stay there. welcome and sorry to hear this.the nerve damage sounds like the S-1 nerve as im just the opposite i have to go all the time both ends.hopefully you will get the help you need soon before its too late to fix.its a long road ahead with wc issues.wish you the best and get better soon.

well catheter was removed and i go on my own wow cant even say how happy iam. thanx for the news you sent awesome, espesiailly when i just got news today that my comp check is lowered 500 a month for child support i had a deal with x but department of revenue want theirs and are retroactive my next check wow crushing ouch. thanx again....

catheter removed and my urination is working thank the lord,just curious do you know roughly what kind of settlement spinal fusion and all that pays? i have found out in florida i can get voc rehab and all. but i would rather get out of this state go to oregon or washington i think. thanks for your response hope things get better for you also. peace

There is no set formula for settlement amount. Also, the carrier doesn't have to settle at all. They could go on paying any future benefits, many of which are limited by law. It depends on how much they may have to pay you in the future as to how much they will settle for.
You state you have an attorney. he/She needs to sit down and discuss this with you. That is what you retained them for. They will try to get the maximum possible as their fee will be based on how much they obtain for you. |
