modified duty.. employer won't allow me back
I have been out of work for a month due to a sprained wrist/thumb. For the past two weeks, my doc put me on modified duty...no lifting over a pound on the injured side. Since I have a very physical job, my employer won't accommodate any modified work. I just found out I can actually get unemployment benefits because of this. My question is, can I get another job that will accommodate the injury since I am able to do some things? And if I do, will workers comp insurance still pay for my Occupational Therapy until I am 100%?
At this point I don't see myself going back to my job because it is so physical. I know what my body can take and I have had enough. Any comments would be helpful. Thanks |

You should be recieving total temporary disability payments which is 66% of your gross pay. If you don't know your rights and what your entitled to under workers comp you can go to your states web site to read all the details.

your claim doesn't go away when you discontinue working for the original employer. you are still eligible for work comp benefits; it's not like health insurance. your employer is the insured policyholder not you.

they dont have to give you work but they do have to give you wc benifits and like abused said 66-2/3 % of ur pay.........

If you take another job, who will accept your new restrictions, they will lower you weekly payments, but your medical will remain the same.
