Does anyone know if an employee has the right to sue their employer in the state of Colorado. I've read that in some states this is not allowed except under certain conditions.

This would involve physical harm due to the employer's failure to implement and follow ANY osha required regulations. Osha has been notified.

and if they decide OSHA rules were violated they will fine the work place but THEY GET THE FINE MONEY not the injured worker...

You can't sue the employer for the work injury but there are some rare situations where you can bring a civil suit for intentional injury thru knowingly violating safety rules.
The most difficult part of doing that is finding a civil atty that's willing to spend the time and money to prove "intention."
your injury and costs have to be very severe for there to be enough value in taking on the long and expensive case.
