Need help in FL

Sad Need help in FL
Was injured at work, had MRI found out that I have 4 herniated discs and 4 cysts. Have been on wc since Oct. What I don't understand is that my company is making me sign a Family/Medical Leave form. Can anyone help me. I don't understand why they are saying that it's a medical leave of absence. HELP PLS!!!!!!!!!!!

If you filled out your accident report and reported this to your supervisor the MRI and all of it should be paid by WC. I absolutely suggest an attorney and don't sign ANYTHING at work. No one can MAKE you sign anything. Good luck to you.

Ialso had the same form FMLA/Medicl leave of absense, but in my case my employer had not filed a WC claim. so my STD kicked in and wages were paid, At the end of my 12 weeks FMLA I was terminted. Before I signed anything I would find out if your WC claim was filed. All FMLA does is protect your job for 12 weeks and then look out. The Medical leave runs with FMLA and is usually just a form they use, In other words FMLA, Medical leave of absense , or both.

Saves double paper work, instead of 2 forms one for FMLA and another for Medical leave of absense, they have them both on one form.

When I was injured at work and my doctor took me off work, my company placed me on FMLA. It runs concurrently with the work comp insurance. Just make sure that a report was made and filed with the work comp insurance. The FMLA will protect your job for 12 weeks, after that you can be terminated.

I never signed any papers for the FMLA, they just went ahead on their own and stated that I was using it.

WC was filed and am receiving pymts weekly from them. The company told me that I had to sign the FMLA papers for "paychex" our payroll company and health insurance purposes. Lawyer is on vacation and will get with him Monday. Boy you work for a company for years and this is the way you get treated!!!!!!!!!!!

Well if you have a lawyer tell your employer to call him or her. Have them send him the papers for you to sign. Let your employer do what he is paid for.

The same happened to me. I was sent the paperwork to sign to protect me for the 12 weeks. I think that is the norm. My injury has gone on past the 12 weeks and i still was offered light duty from them. As far as " this is the help i get from them?". It has only begun. You also will find that co-workers who you thought were your friend, are no longer. Alot of people frown on injured people that they work with that make a claim and they cannot physically see your injury. Most people feel we are FAKES because we are out of work and there is no blood comming from our wounds.

Please take care of YOURSELF and do not worry about them. You are the one suffering and the long road of recovery is ahead of you.

you don't have to have an atty to tell you about FMLA. It includes work comp.

Under FMLA provisions you have 12 weeks of job protection.
Having a work comp claim does not give you immunity to termination but FMLA does.
Don't guess about the rules or make assumptions about what should or shouldn't happen- mistakes can be costly.
