you are being forced no doubt about it.the facts are they dont believe you need the surgery or they would have okayed it. They want you to go away.Your Dr didnt convince them you needed it or you would have gotten it.So heres the deal do you really need it? or are you just scared to go back to work?PTSD does that you know.My advice would be to take the money and train for a different job if that one scares you so.

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

Do I need surgery? Well, I won't die if I don't have it but how exactly do you get a job if you can't lift, type, etc. and make the same as what I was making before? Even driving causes pain and locking up of the knuckle. I live in an area with no jobs available as it is let alone one that wouldn't require lifting, typing, driving, manual dexterity, etc. plus one that would net me the same income as my last job.
In the beginning my injury had two options: surgery or keeping the fingers stationary hoping it will heal on it's own. Usually this is 6-8 weeks of keeping fingers stationary to heal. They attempted this treatment for 8 months now with no result! Basically the dr. said either have surgery or don't and keep my fingers stationary for the rest of my life.
Also, it was determined directly after my injury that I would not be returning to that job or that line of work due to the trauma. So if I were cleared to work it would be a new job.
And...they didn't deny my surgery...they didn't even review it. Lawyer said it was due to the claim being denied initially. Plus the dr. told me there would be no issue in them approving it based on necessity. I know that he could be wrong but he is the best hand doctor in the area (very reknown) and has dealt with WC a lot.
I feel stuck between a rock and a hard place.
Quick add in. I talked to my lawyer and he said he talked to the insurance company and they are -saying- (he's waiting for tangible paperwork before doing anything) they are going to talk to the adjuster (apparently the adjuster was the one who wouldn't allow review due to the claim being in limbo) and agree to pay for the surgery and resume my weekly benefits. I said I didn't want to cancel my claim if that be the case since they are not accepting my claim and could stop paying me at any time (they already did this once before). He agreed but said that this was good news since I will be getting the surgery needed, getting money to support myself, and can still go to trial and get a fair judgment. So good news, all in all. I think. Unless I am missing something.
