Good plan, bummer- most federal regulators want you to exhaust immediate resources to resolve the issues before filing a formal complaint. Sounds like you have your ducks in a row.
And, I know what you mean about advocating for others, and failing to meet the bar in doing so for yourself. Believe it or not, it's having a "third party" involved that gets attention. If you're advocating for yourself, most tend not to pay much attention, as they see it as self-serving instead of advocating. DISCLAIMER: I am not an attorney. An update on the subject...........
I spoke with the special needs coordinator at the college today. Monday I am to check out the FM Loop system and see if any of the technology will work with my hearing aids. Don't know yet if the teacher will comply with the technology being used in this class, guess I will know next week. |

I'm pretty sure the Special Needs Coordinator can compel the teacher to comply with the school's policies in that regard or suffer some kind of sanctions.

What this teacher needs to understand is that she can be held PERSONALLY liable for violations of the Act, since she is probably in violation of POLICY. There would be no protection under the legal theory of "respondeat superior" (wherein the teacher is acting within policy as an agent of the employer).

I was working as an Early Childhood Teacher at this school when I was injured.
The school has a history of ADA non-compliant. Disabled students who need a note taker are told to have a family member to take notes in the classroom. Several years ago when I was working I requested a phone in my classroom for the hearing impaired with the use of amplified volume. (Phones are standard in each classroom and I wal refused a phone with amplified volume, told the college did not have access to one) |

After you have made reasonable attempts to have this corrected to no avail , consider a complaint with the Office of Civil Rights ( OCR) Dept of Education.

The school special needs coordinator is aware that I am an educational advocate for disabled children and appointed advocate by KS Dept of Eduction advocating for educational rights under IDEA and 504.
My goal is to work this out and receive the technology I need to use in the classroom, if that does not happen I will have no problems in filing a complaint. |
