Hi...i am interested in knowing how w/c claims are settled in the state of PA. extremely tired of the insurance company and would like to settle the claim if i know i can get the hell out of the system,,,, i am as good as i am going to be medically (which isn't too good, but the surgeons did what they could)...

the insurance company has paid all bills and wage loss,,,,,but continue to go to appts only because there maybe another surgery in the future,,,,and i believe they are trying to deny the future surgery,,,which isn't necessary but maybe more of a wait and see thing at this point in time,,,,i am basically just looking for a general rule of thumb how the state of PA determines settlements.,,,,i know all states are different when it comes to settlements.

There is no formula in PA. The value of your case is based on multiple factors including the severity of your injury, your time of injury average weekly wage, your ability to return to gainful employment, union membership, and many other factors. If you have a lawyer, talk to them about the value in your case. If you do not have a lawyer, you can still attempt to settle your case directly with the insurance company, but you are less likely to obtain the true value of your case.
