I have been on WC since April 09, getting my checks everything just running smooth. In July I was told that I could work with restrictions. That was working, I earned a little and WC made up the differece. Then come 2/4/2010 I am rear ended on my way home from work. My injuries are pulled muscles, cart. torn from ribs, whip lash and pain in my lower back, (lower back is WC injury) now made worse by wreck. I am from FL.

WC just informed me a few minutes ago that my WC check were stopped as of 2/4/2010. Can they do this? I was making over 40k a yr at the job before WC and let go, now I earn $9 an hr 20 hrs or less a week.

I have an attry. for the wreck, but not for WC, do you think I need to hire an attry for WC now that this seems to be more than I can handle.

My wc attorney also is my attorney for my auto accident. Mine is not wc related.

I question with you being on your way home from work, is this wc related?

Things are going to get complicated with wc, they now have a reason not to pay.

You do need an attorney.

The wreck is not WC related. I was driving home from work, in my private car, so not WC.

My Attry for the wreck does not handle WC, he has told me one to call. The lady from WC told me that since the WC Dr. told me I can work some, that WC will not pay since the car wreck.

I knew that things were going to smoothly with WC and something would mess this up, and it did. An idiot driving to fast not looking and he plowed into my stopped car. Thanks for answering .

Do you have an accidental insuranc policy, many people carry one thru their employer?

Until I retired I always carried loss of income on my auto insurance for me and my husband...God forbid just in case. You might want to check your policy......I would also speak to a WC attorney since your guy doesn't deal with it. Best of luck.

check but my understanding is the guy that hit you his insurance company will have to make up your lost wages. They are not going to tell you but your lawyer will know. If you are not able to work they have to pay you for lost time.

In Kansas my insurance company pays for everything upfront and when things are settled my insurance company collects from the other driver's insurance company.

My attorney & I have reached a settlement agreement with the insurance company and wait for paper work from medicare.

Thanks for all the answers. In FL. auto insurance pays 60% of your salary, since I was only able to work a 20 hr a week job, at 9.00, this is not much to make up. Unless the WC is taken into consideration.

My daughter tells me that if I didn't have bad luck, I wouldn't have any luck at all. I am starting to believe this.

I will keep you posted. I knew things had been going to smooth.

You can't blame WC for a auto accident and injuries from the accident. It is now up to the Auto Insurance to step up to the plate.

Getting a WC attorney to do what? Nothing a WC attorney can do for an auto accident. You may need a WC attorney, and these attorney's need to work hand in hand. So make sure they are willing to work together.
