What if doc took you off MMI? - Cookiecrum - 09-21-2009 09:06 AM

I go and see my doctor in a few days because I have been having really bad problems in my hand and lots of swelling etc. Can he reverse the MMI and if he can what would happen?

Let me explain my situation a little. Originally when I was released to go back to work. I was on so much pain killers and told everyone and their mother I couldn't take the pain killers( as they made me fall asleep)and go to work and OTC drugs wouldn't help. So anyways they told me to come back to work or I was volunterily terminating myself.
I got a lawyer he petitioned for tpd from back when I was released to go to work. Went to mediation, nothing, went infront of judge, was awarded back benefits till I reach MMI.
Would those benefits start again? and also they owe me back Impairment income benefits for now 8 weeks will they have to pay that? They have been denying everything since I reached MMI.

yes you can be in recovery again and eligible for Temporary Total.
the doctor would have to justify the change in a written report.

Would you know anything about the back pay of impairment income benefits?

if it was ordered by the judge they can appeal the order. your atty would know the status of that.
if they have not appealed and not paid you can go back to court for a penalty.

I was actually talking about the impairment income benefits that they should have been paying me just from August 6th of this year. Which they haven't given me anything as far as that goes. So if doctor took me off MMI would they still owe me the impairment benefits from August 6 till the day my doctor took me off mmi?
