RE: affirmed decision of appeal - blake - 09-08-2009 10:51 PM i was on the link 1171 sent and im lost i really dont know where or what level im on. all i know is if they appeal it goes to the supreme court lets hope not its been a very ruff road of 8 months and no pay i think i finaly won this one all 3 judges upheald the law judges decision in my favor as she did 9 months ago. When WC sent the writ to the Supreme Court asking them to hear the case I can't remember exactly the time it took but it seemed like it did not take my lawyer a very long time to call me to let me know that the Supreme Court denied WC the writ. I don't want to get your hopes up on the time because I would think it could also depend on how many cases they have sitting in front of them before they get to rule on you case. All I do know is it did not take that long for me to get a decision because I remember being surprised at my lawyer calling me so soon. I am only sharing what my own experience was with the appeals stages with what I went through with WC and it does not mean it will work that way for others. I can only speak the truth from what I, myself has experienced. Therefore, whenever you read one of my post, I am speaking from what I experienced and not what or how the system works. I do not know alot but I do know the path that I have traveled and that is really the only thing I can share. If I did not experience it, I will not talk about it. People like 1171 has more knowledge than what I have regarding how the system works but I also believe in first hand experience of what a person might have gone through. Everyone's injury and case if different and the laws from state to state vary also. Wishing you the best of luck and keep us posted. I want to say it was about 3-4 months later my lawyer called and said the Supreme court refused to hear the writ and for WC to pay me. After that it took WC about 2 months then I got all of my back pay, out of pocket medical, mileage and my indeminity checks started to come in. Everything went through my lawyer. I fought with this entire ordeal about 2 years before I collected anything from WC. Remember, like I said, not all cases are alike as this is what I experienced but I will pray it goes quickly for you as well. Good Luck! Especially since it's towards the end of the year, and WC's kitty pot has been dipped out of for 9 months already. I actually have no experience w/ court, appeals, hearing etc...just the experience that WC will stall at any price....even if it costs them more in the long run. I pray you have good luck, and that all goes swiftly. Do as your lawyer says, as it sounds like he is on top of things, and won't keep you in suspense when he hears word on their actions, he'll let you know promptly.! Let us know what happens Friday, and I hope it's good news you report !! Lilly RE: affirmed decision of appeal - blake - 09-14-2009 09:08 AM i know i never get my hopes up anymore i even told my lawyer if i know this ins comp they will appeal this to the supreme court even if they have NO chance of winning. its not right that they get to do this there should be reformed laws on the system, and the ins comp should be punished more than a small fine they recive now. i know all it takes is a few bad seeds to ruin the system but its not right. the only good thing with my case is that is i have have every judge rule in my favor and this time on the appeal they were caught lying more than 5 times on their issues for this appeal and most all of their resons for the appeal were thrown out by the 3 judges for incredible evidence. also one more thing we have moved and have been at our new house for 3 weeks and yes the private invesagators have found me i love that they keep wasting their time and money RE: affirmed decision of appeal - blake - 09-14-2009 10:06 AM so if they just affirmed the decision do they have to start payments now even if they appeal to the appealte supreme court level? tehy afirmed what the law judge ruled on when she said to start payments again but they appealed RE: affirmed decision of appeal - blake - 09-15-2009 12:57 PM still nothing |
