It's just what I said above. It's a chance for both lawyers to questions your doctor and have a court reporter get it all on paper for the judge or hearing officer to be able to read.

You are objecting to the IME report right? It's the same thing for the other side they don't like what your doctor said. But with a depo it gives both sides a chance to question what the doctor is saying because the hearing officer doesn't get that chance. My employer paid good money to send me out of state for a IME. His report made it look like there was nothing wrong with me. His depo didn't make that report look right at all. He make mistakes even in his depo that showed the hearing officer his first report was not very believable. Everything is his first report was countered by my doctor. My doctors report was what the officer used to make her ruling.

Oh okay, thank you Like I said the IME only lasted 9 min is this how they normally go? seems like that would not be very creditable in its self? This whole process is AWFUL!!!! Also if I have gotten STD pay and LTD pay from my employer will this make a difference if I settle or go to trial and win?

In my IME I only spoke with the doctor for about 10 minutes or so and he tried to trip me up during that time. Which was funny because I called my lawyer on the drive home and told him where he tried. Your pay can play in the settlement, depends on if they firgured wrong and over or under paid you

I guess that I am Lucky to still receiving pay thru my LTD plan from work, I have noticed quite a few post of people not getting anything. I do not know how long it will last got a letter approving me thru Jan 2010 and have been on STD and LTD since Aug 2007 I do know that my health insurance has been paying on my claims but I am drowning in debt and I only hope for the best!!! I have collections calling all the time but when you have no money to give what are you supposed to do???? I guess Grin and bear it!!!!

If it goes before a workers comp judge, it will come down to credibility. Usually an IME trumps a Treating Doctor, but not always. Try to do some research on the IME to see how he has opinioned on other cases. Google his name and see if any legal decisions come up.

[/color]Do not know about this Dr. that preformed my IME. This is kinda a Bummer On this Dr.'s website he actually has a Lawyers letter to the insurance company stateing "Looks like we won another one" the lawyer that wrote this letter is the same lawyer that my company hired against my case. Oh great!!! Sounds like to me they enjoy doing this type of things to people I think it is disgusting myself

if you try and take the personal out of it you might be able to understand it better...its a business to them and you are a number......if you cost them money they are gonna do their best to get rid of you...period...they dont care that you are a living breathing being...that likes to eat.....

My Hearings Ended with a 52 Page Decision from the w/c Judge, and My Dr, was Found More Credible than the IME Dr., and I was Found to be More Credible Describing My Condition throughout 12 Hearings at that Point that I had to Testify at. A Good Attorney will Ask for Depositions to Argue the Credibility, so You need to Stay in Contact with Your Attorney Concerning this Matter. I have since had 2 More IME's as the Defense is Trying to RE-Open My Case, and so far they are Still Backed into a Corner!! Best of Luck!!Wink
