If they did not have a workers compenation policy they purchased from a workers compensation insurance company and they did not meet the criteria set by the state to be a designated "SELF INSURED" meaning the state has provided them with a cerficate of authority to "self insure" allowing your employer to handle their employees' workers compensation claims, then call an attorney for assistance if the Ombudsman's Office is not able to assist you if your employer did not have comp insurance. thank you that is very useful information I would not have known. Why does it have to be so difficult? RE: Need ER can I go on workman's comp - 1171 - 05-31-2009 07:32 PM the first few weeks after an injury can be difficult to get communication and coordination of information set up between all the parties. P.S. the first 3 days of TD aren't paid until you've been off work more then 3 weeks. you can also get a lot of information from the fact sheets http://www.dir.ca.gov/dwc/iwguides.html RE: Need ER can I go on workman's comp - hollywoodyed - 05-31-2009 08:16 PM 1171 Wrote:the first few weeks after an injury can be difficult to get communication and coordination of information set up between all the parties. Very frustrating these times. I was injured 5/12/09 it is 5/31/09 so that is closing in on 3 weeks of no work, no income, no answers. thanks for info RE: Need ER can I go on workman's comp - Bernie57 - 05-31-2009 09:40 PM Got a suggestion for you. Myself, injured 2005, WC end all payments 2007, Accepted by SSD last month. Lots of medication bills. Started to get letters from lawyers. Wrote everyone that I was out on work injury and they would get paid when I did. The letters stopped for a good while. Even the collection agencies who were calling 15x's a day took a break.(& I do mean 15). I also just found out my life insurance that I had before going broke, was reinstated & will be paid for by Prudential from now on. You may want to think about notifing any creditors you have now and just tell them the truth. Be Strong. RE: Need ER can I go on workman's comp - hollywoodyed - 05-31-2009 11:08 PM Here on Sunday night I got an email reply from the administrator replying to my email from yesterday regarding being seen by the urgent care and orders to be off work through 06/02/09 with the attached copy of the orders. Her email reply:"We will follow up for written orders on Monday" what do you suppose that means? I am fearing that this is turning into a hostile work environment for me and the way I feel today I am not sure how to go about dealing with them. I am literally, mentally and physically ill today. All I was doing was my job. One day the employer is praising me and using me as an example to others on how to do it right and the next day I am *&#@ to them. I just do not understand.
RE: Need ER can I go on workman's comp - jayne - 06-01-2009 10:49 AM its easy one day you were making them money....the next you were costing them money..... RE: Need ER can I go on workman's comp - hollywoodyed - 06-01-2009 07:48 PM I was able to speak with the Claims adjuster today via phone. She said that she was still waiting on information from the Urgent Care clinics and that other things had also come up that have detained her from my case. (huummm) I asked about my TTD and she said to call her this Wednesday she should have things on track. I asked her about what she wanted on the medical history form and she said anything related to this injury or any past work comp claims. She said that a rep would be calling me to set up a time to meet me and I could give them the medical history form so not to mail it. Does that sound right to you guys? I never did receive any letter stating that my claim was being delayed while more information was gathered as to a reason for me not receiving TTD yet so doesn't that mean they will have to pay a late penalty fee when and if I do start to receive them? I have another clinic appt tomorrow will update the forum on the results of that |
