just a quick note.......just need to have a quick kick in the head as to what i should ask my lawyer today as far as questions pertaining to what we want at the mediation hearing next thursday. trying to get the brain going this morning so i can write down a few questions to ask him. thanx for any info you might have to share.

Just dont let your Attorney agree to anything without talking it over with you.
Some will want to settle just so they get paid quickly.

appointment went.......thats about it. found out i'm pretty much screwed about getting any amount of settlment that is going to recover even a tenth of what we have already put out the last 2 years. by the time the lawyer takes his fair share and pays for all the tests,doctors, and other fees and services...i'm going to owe after i'm settled!!! wish i would have just taken more pain pills and never said boo about hurting while i worked...at least we would still have our savings. lol my lawyer said if i would have been injured in Illinois, we would have faired a whole lot better than here in the beeeeeeeutiful state of Missouri. the system here is really against the injured worker. time to send the govenor more e-mails about what i think of this crappy WC system in this state. and we had our hopes up on maybe being able to get out of this state after all was said and done....o well, another dream smashed. thanx Missouri WC, so caring for the employer and the insurance companies...don't give a crap about the employee....they're easy to replace.

Very sorry to hear that Rabid, I was really wishing to hear some good news. I know each State is different, but here in Pa. the Attorney gets 20% only, and the i/c reimburses the winning Attorney for fees, Depo.'s etc. My agreement with my Attorney clearly states 20% only, all fees and expenses are covered by them. Maybe something you can check on. I wish I could of been of more help, and I hope something turns around for you!!

Mine too limbo......Didn't know that was the norm in PA or just how some attorney's word things. I could never understand when some would say they won but by the time legal fees, medical, etc was paid they got next to nothing. That's a disgrace.

It likely has nothing to do with the attorney fee percentage. MO underwent workers' compensation deform at the hands of insurance carriers in 2005. One of their usual tacts is to limit the fees of attorneys. This approach basically kills the practice area and makes near impossible for workers to find attorneys. The insurance industry did just that in MO. Funny how there is never a provision to limit how much insurance companies and employers can spend on lawyers.

Thanks for the info. mdh, but even if they did lower the % to Lawyers, the losing side should pay all fees. this is the exact same case in a Civil Suit here in Pa. the loser pays all fees and expenses. If that's not the case in your State's, I think that's total robbery of the injured worker or the victim.
Cap. GOOD MORNING! My Attorney has turned out to be a jewel and a blessing for me, and it sounds like you've found a good one also. But we do still have the thief's here in Pa. I recently read on another site of an injured worker in Pa. that had to pay for a Dr. Deposition ($4000.00) because their Attorney doesn't think the case is strong enough and doesn't want to incur expenses! So I guess we both got very Lucky with who we chose! I'm fighting something right now on my wage issue, that cut and dry should have been handled from day one, and in his brief, he's going to ask for a ruling of an unreasonable contest, meaning this should never of had to go to court. If we win this, the i/c has to pay him for all expenses and also pay him by the hour, and by doing that he won't take the 20% off of me, and I will get the full amount!! Now is that one great Attorney or what?? When I ask him which way was best for him he said he doesn't even want to figure it out, or he may change his mind and want the 20% instead! He's even Honest Too!! Have a Great Day Cap.

You do have a great attorney, it sounds as if he really care about the IW.
When I went to court in December, it was decided by both attorneys that I would see a dr in KC. In the court order the judge states the attorney for the IC pay the KC medical expense.
To date the IC and their attorney have been responsible for all medical bills.
My attorney's office is just up the street from Boeing, Sprint, and other
aircraft plants in Wichita. He has a very busy law firm!

Sounds like you got a good one too Bummer! It's great to hear of the good Attorneys out there, because more often than not, we only hear of the bad ones!! Have a Great Day!!
