Permanent award finally!!!! - sparkey - 08-19-2008 12:23 PM I cannot believe that I had to all the adjuster for the insurance co. today to ask where my permanent Impairment award has been since the decision on Aug. 1st. He said he meant to get around to it and never did. He would be cutting the check today and putting it in the mail. I find that this is how bad the IC can be that these adjusters do not give a darn about the IW waiting on their award after a decision has been made. I think I should be reimbursed for the time of my 10% award before my hearing date, as the labor board told them to hold it till the decision. So if anyone is out there waiting on their impairment award and wondering where it is after a decision, it is sitting in the IC bank account collecting interest until YOU call them to send it to you. This adjuster told me he thought about it last week and never got around to it. How nice??? Would he of wanted his award right away? Especially after they already won their case sofar on my rating amount. I do not see what I can do if he is sending me that check. I am just very displeased with the way it was handled, by me having to call for it. Does anyone know if I should be paid interest since the time of my award 2 months ago that it was held due to the date of the hearing? I know the Labor board made the IC hold it till the outcome, but from what I read, it should of been paid right away after the labor board approved the percentage rate with the decision. RE: Permanent award finally!!!! - Pooh - 08-19-2008 08:19 PM sparkey you can still file the complaint even though it is handled - let them know that it was handled ineffectively and stuff. As for for penalty - that is something that you would have to check out the state statues on.... most states do allow for a penalty - and I think you went on your own without an attorney -- but if I am wrong - then check with the attorney. Glad to hear they are finally sending you the check though Now if he followed through with what he told you.
RE: Permanent award finally!!!! - sparkey - 08-20-2008 05:42 AM I am sure he will send it to me. I said before I called the labor board, I thought I would ask him. He appologized and said he was sending it out yesterday. I should be getting it in the mail today or tomorrow. I will call the labor board if it does not arrive before the weekend. The labor board was upset at the hearing that it was not paid before the hearing. But there was good reason it was not paid. It was held till the outcome of the rating dispute. I have the signed paper from the labor board stateing that it is approved to be paid when I received the decision. It was just the IC waiting as long as they could before it was sent. I think they would of sent it in 30 days time if I had not called. Most are so overworked and being told how to handle there files (against their wishes/instincts/whatever) that they don't have a choice. HOWEVER, if the payment is late, and there are penalties for late payment in your state, you are entitled to them and should pursue them. I know as of Aug. 1st after the decision from the labor board they should of paid it. So it was actually 2 weeks later. I do not know how many days they have to pay it, but at least it is in my hands now. BB. That is exactly what I am going to do with the money , as I have no idea what I would need it for at this time. I would much rather put it aside for a rainy day, and collect interest at the same time. It was not the settlement I feel I was entitled to, but felt it is fair only if they would of kept paying for my medicine. My doctor today said that because the decision of the labor board was that their IME was more credible, he put in his report that I had recurring carpal tunnel. My doctor is now setting me up to see a hand surgeon seeing that if so, I could possibly have them pay for the surgery now. The EMG said Mild carpal, and the doctor agreed on their end, so we will see what the hand surgeon says. My PM doctor thinks I have RSD and said to be careful that we do not do surgery if it is not needed as she feels there is other things going on. Also my left hand is starting to hurt alot and we will have a EMG done on that soon, as I have been using that hand for compensation. Thank you all so much for everything. My doctor also suggested I did get a lawyer to think of the future and feels I am getting the bad end of the deal here by them taking away my medication payments, and if it is RSD they would not pay for the stimulator implant if needed. We will see. I am still thinking what is best to do. I already have my 10% award I won, and go from there. |
