Thanks and Question?? - wt1949 - 05-06-2008 04:56 PM Thanks to all on your answers and comments to my previous question about " Prexisting condition" Some one why was my lawyer talking settlement this soon?? It has been over a year since accident (Feb.07), is this too soon?? My lawyer seems to think that a statement from one of my former pain Dr. will hurt me in court. This Dr was sending me back to work knowingI could't hold out. He had change my meds to almost nothing. He didn't want me to go back to my Nuro Dr for a promised discogram, he said my problem was age and wear and tear, But because I kept insisting on seeing Nuro and asking for test he became angry. My wife told him that any one in his place who could have done more to help me and didn't , that she believed God would let them feel my pain at some point in future. Dr. at this point walked out and put in his notes that maybe I should see a new Dr. , Which I did. My lawyer feels this event will hurt me if I go to court. He did not comment on the fact that My Nuro Dr did in fact order a discogram and it showed tears on all 3 disc tested. I had Nuro Dr send me to the pain Dr he uses for treatment and I have been going to him ever since. He told me that the meds first Dr had cut me down to were nothing for pain and he immediately put me on Lortab 10. My lawyer seems to be more concerned about the first pain Dr. saying my wife an myself became angry when he refused to want to do any more for me but was putting me at MMI and sending me back to work . He did not believe I had the pain I have. might need to cange Lawers, Question?? Have any of you ever had an conflict with a Dr and had to change. And also, does anyone know the process in changing lawyers. RE: Thanks and Question?? - lfoster21 - 05-06-2008 07:54 PM I can only tell you that if you change lawyers, some states require the 2 lawyers to split the fee, so it is hard to get a 2nd one. I don't know if this applies to your state, but I am sure someong will come along with that information. I would Write down Every Concern I had that had to do with the Attorney, and Ask for a Set-Down Face to Face Appointment. Maybe if You had their Undivided Attention, and Voiced Your Concerns, You May be able to Iron these Issues Out, and Open the Channel to Communications Better. Sometimes Attorneys Need Reminded that there May be Evidence they are not thinking of at that Moment, I know this has happened with My Attorney and I, and We've always been able to Work out Our Differences. As I told My Attorney, "He May have Hundreds of Cases to Work on, but I only have ONE, and the Outcome of Mine will change My Life Forever!" When I told Him that He said that Makes Perfect Sense, and it gave Him a bit of a Different View of His Cases. It's always Best to try and Work things Out rather than switch Attorneys, switching sometimes gets Messy! Best of Luck, and I Hope this has Helped!!

In plain terms, who would not want a 2nd , 3rd, or even 4th medical opinion. Not all Pain Management Doctor's are that good, where some will be just great. |
